City Manager Henry again explained that on the bid <br />sheet it says, in effect, a bidder will meet specifications at a given <br />price and then, apart from that sheet, is a listing of the truck specifica- <br />tions aad in it Mr. Schroeder had not correctly listed the clutch. <br /> <br />Councilman Tandler asked whether at the time Mr. Schroeder was informed <br />that his bid did not meet the City's specifications, he knew he was the <br />low bidder, and the City Hana§er replied that he does not knowwhether <br />he did or not. Mr. Reis interjected that Mr. Schroeder was present at <br />the opening of the bids. <br /> <br />Councilman Barks said he thinks perhaps the Director of Law ought to com- <br />ment as to whether there is any impropriety in checking with Mr. Schroeder <br />~ the matter of the clutch. Mayor Kaufman asked the City Manager how <br />soon he requires action on this item, and the City Manager explained that <br />in view of the Council's meeting schedule, this is rather important - one <br />of the units is completely broken down and the others are not in good <br />condit£~n, and this means that the City is not getting the loads on the <br />units that are in actual operation, that it should, and this represents a <br />cost to the City because it represents more trips to the landfills. <br /> <br />Mayor Kaufman said he is concerned, as Councilman Tandler seems to be, as <br />to whether Mr. Schroeder knew he was the low bidder when he decided to <br />switch from a 13-inch to a 14-inch. Councilman Tandler said the other <br />question in his mind is whether the matter of having presented a 13-inch <br />clutch to begin with was an honest typographical error or whether Mr. <br />Schroeder actually intended to furnish a clutch that was below specifica- <br />tions. He said he can hardly picture someone submitting a bid when both <br />size clutches are available, deliberately submitting a bid with a clutch <br />that is below the specifications. <br /> <br />In response to a question by Councilman Epstein whether the City would <br />have a right to demand a 14-inch if a 13-inch had been delivered, the City <br />Manager answered affirmatively. <br /> <br />Mr. Kegs said that with respect to a possible typographical error, he <br />would like to point out that the 14-inch is not listed in the GHC data <br />book - it is not a standard clutch for that model - and GMC must be <br />called to price it and install it, <br /> <br />Councilman Tandler stated that the Council is obligated to award the con- <br />tract to the lowest and best bidder -- Mr. Schroeder does have the lowest <br />bid, and has agreed to meet all specifications. Mr. Reis reiterated that <br />this was not done prior to the time the bids were opened, however. Council- <br />man Tandler explained that that is what is before the Council now, and he <br />said it seems to him this Council has but two choices: one is to award it <br />to the lowest bidder and the other is to throw out all the bids and start <br />over a§ain. <br /> <br />Mr. Reis said that as he mentioned earlier - and he believes he is Just as <br />correct as Mr. Schroeder is in offering a 14-inch clutch after the bids <br />were opened - he will meet Mr. Schroeder's bid price with the 14-inch <br />clutch ($14,250.00). Councilman Baris asked Mr. Eels whether he is stating <br />as a fact that his quotation of $14,751.75 was a typographical error and <br />Mr. Eels said he is not, <br /> <br />Councilman Baris said it seems to him that unless the Director of Law finds <br /> <br /> <br />
