Mr. Reis said he had stated <br />that his equipment did meet the specifications and had asked whether <br />some of the others did not, whereupon he had been informed there was <br />some question about the clutch - and that is when he found out the other <br />bid (Schroeder's) did not have a 14-inch clutch. Hr. ~is said the point <br />he is trying to bring out tonight is that the lowest bid is n~ a legal <br />bid. <br /> <br />Upon inquiry by Mayor Kaufman whether any other member of the public de- <br />sires to be heard on this matter, there was no response. The Hayor in- <br />quired as to the pleasure of the Council, and asked whether the Council <br />is ready to act on agenda item No. 3. <br /> <br />Councilman Tandler said he feels that if the low bidder had deliberately <br />substituted a smaller or infer/or clutch in his bid he surely must have <br />realized that his unit would not be accepted and Councilman Tandler said <br />although that Individual is not here tonight to make a presentation, his <br />bid was submitted in good faith and he was under the impression he had <br />complied with all specifications -- the fact that he was willing to sub- <br />stitute the more expensive clutch after this had been called to his at- <br />tention, without raising his price, which he could have done and still <br />come below the next highest bidder, would indicate to him (Councilmen <br />Tandler) that this company is acting in good faith. Councilman Tandler <br />said that as far as the legality of changing his specifications after <br />an error had been called to his attention, he doesn't think there is any- <br />thing illegal about it -- at least, the Director of Law has not indicated <br />any i11egality. Councilman Tandler said he would therefore be inclined <br />to award the contract to the low bidder, the Schroeder GHC Truck, Inc., <br />for a total price of $14,250.00 for three trucks, and Councilman Tandler <br />said he moves accordingly. <br /> <br />Motion seconded by Councilman Epstein. <br /> <br />Hayor Kaufman said he is not suggesting that other members of the Council <br />follow his lead in this case, but he will vote against this proposition. <br />The Mayor said he realizes that time is of the essence, but in view of <br />the controversy that took place in this bidding procedure, there is a <br />questiom in his mind as to whether the City properly could accept the bid <br />of the Schroeder GMC Truck, Inc. as the lowest bid. The Hayor said this <br />is his personal vie~ in connection with any bids that are submitted by <br />cities to companies asking that they submit bids, it would appear to him <br />that all bids ought to meet specifications - he said "we can tailor these <br />to meet specifications, but at least in my mfnd~ they don~t, but I*m not <br />suggesting anyone else follow my lead. It is merely my personal feeling <br />in the matter." <br /> <br />Councilman Grimm asked how much delay would be involved if the bids were <br />to be reopened and the City Manager explained it would be at least until <br />September loth before they could be brought before the Council. Mayor <br />Kaufman expressed the view that it may be more expedient to act on the <br />matter, but there is a question in his mind whether expediency is a wise <br />thing where there has been an issue of controvery raised, attempting to <br />ascertain the state of mind of Schroeder GHC Truck, Inc. when they sub- <br />mitted a 13-inch clutch - the Mayor said he would assume Hr. Schroeder is <br /> <br /> <br />
