RESOLUTION 2012 - 09 <br /> WHEREAS, Section 34.40.14.2 of the University City Zoning Code requires that <br /> the Preliminary Development Plan be approved by the City Council by adoption of a <br /> { resolution approving said Preliminary Development Plan, with conditions as may be <br /> specified and authorizing the preparation of the Final Development Plan. Section <br /> 34.40.05 of the Zoning Code requires that the permitted land uses and developments <br /> shall be established in the conditions of the ordinance adopted by the City Council <br /> governing the particular Planned Development-Mixed Use District. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF UNIVERSITY CITY, MO AS FOLLOWS: <br /> The City Council hereby authorizes the preparation of the Final Development Plan for <br /> the proposal for this map amendment and resolution, to be known as "Washington <br /> University— Loop Retail and Student Apartment Development." The proposed <br /> structures and uses shall be developed with the following conditions: <br /> kt <br /> 1. The permitted buildings and subject property shall be developed, constructed <br /> and maintained in general compliance with the Preliminary Development Plan <br /> submitted with the approved application. No more than five (5) buildings shall be <br /> allowed. The height, number of stories, and mass of the permitted buildings shall <br /> not exceed that shown on the Preliminary Development Plan. <br /> 2. Setbacks — Permitted buildings on Lot 1 and Lot 2 shall meet the following <br /> minimum building setback requirements: <br /> a. 0 feet from the Delmar Boulevard right-of-way <br /> b. Ten (10) feet from the Enright Avenue right-of-way <br /> c. Ten (10) feet from the Westgate Avenue right-of-way, excluding the northwest <br /> corner of Building 4, which shall be eight (8) feet from the Westgate Avenue <br /> right-of-way <br /> d. Five (5) feet from the public alley right-of-way between Lot 1 and Lot 2 <br /> 3. Permitted uses for all ground floor space in Buildings 1A and 1B on Lot 1, as <br /> shown on the Preliminary Development Plan, shall be limited to "all permitted <br /> and/or conditional uses as set forth in the CC — Core Commercial District" as the <br /> permitted and conditional uses. Conditional uses shall be subject to the issuance <br /> of a conditional use permit in accordance with the procedures and standards <br /> contained in Article 11, Conditional Uses. All upper floors in Buildings 1A and <br /> 1 B, and all floors of Buildings 2, 3, and 4 on Lot 2, as shown on the Preliminary <br /> Development Plan, excluding the underground parking garage, shall be student <br /> apartments with accessory uses including but not limited to meeting space, <br /> laundry facilities, and bicycle storage. The permitted use of Lot 3 shall be limited <br /> to passive green space. <br /> Page 1 of 4 <br />
