<br /> <br />Mr. Walker stated that it was not appropriate to ask the City Attorney at this point. <br />He felt that Resolution 2012-13 had more implications than can be discussed in a <br />relatively short period of time and asked Council to refer this back to Administration <br />for a report to include the City Attorney’s comments. <br /> <br />Mr. Kraft stated that since he introduced it he would like to read the request then <br />give his comments and the City Attorney could be asked at a different time. Mr. <br />Kraft read the resolution and said that the resolution was asking for the funding by <br />allocating $15,000 and then for the administration to come up with a way to make it <br />work. He felt this was something that was long overdue and not fair because the <br />residents in private subdivisions pay taxes and should receive the street sweeping <br />services. <br /> <br />Mr. Price requested that the City Manager check into legal issues and any liability <br />possibilities. He also stated that if private streets would be being swept like public <br />streets, then those streets should become public for anyone to use. Mr. Price <br />stated that if the private streets are swept, he should be allowed to make a right <br />turn off of Big Bend where the gate now is and end up over by City Hall. <br /> <br />Ms. Carr said there were some legal issue to research and the largest private <br />subdivision was in 0her ward. She said it felt political and felt the lawyers should <br />investigate. She was in favor of putting it back in the City Manager’s hands for <br />more research on how to move forward. <br /> <br />Mr. Crow thanked all the citizens who came out in support and said he thought it <br />was incumbent upon the City Manager and staff to reach out to all the private <br />subdivisions for comments. He said he would like to hear what the City Manager’s <br />and staff’s response will be and believed it was about constitutionality. <br /> <br />Mr. Sharpe said Mr. Walker requested that Council give the request to the City <br />Manager and staff for more research and return to Council with their findings. <br /> <br />Mr. Sharpe moved to give Resolution 2012-13 to the City Manager and staff for the <br />purpose of bringing something back for Council to vote on. <br /> <br />Mayor Welsch stated that there was already a motion on the floor. <br /> <br />Mr. Kraft asked Mayor Welsch to Call the Question. <br /> <br />Mr. Sharpe asked if he could do an amendment to the motion stating that it be <br />given to the City Manager and staff for more information. <br /> <br />Mr. Kraft stated a Point of Order noting that someone would have to amend the <br />motion. <br /> <br />Mr. Sharpe stated he asked the City Clerk and he verified with her as to what was <br />considered the right procedure. <br /> <br />12 <br /> <br /> <br />
