Mr. Jacobs stated it is full from 6 pm to 1 am.

Dan Wald, owner of Market in The Loop at 6655 Delmar, and owner of the building at the
southeast corner of Delmar and Westgate, addressed the Plan Commission.
Mr. Wald stated he had previously explained his objections at the previous Plan Commission
meeting. He stated that at no time had an owner of property along the parking lot been contacted
by City Staff or the consultants. He understood that the Plan is not a request to do anything right
away. Mr. Wald stated that he should have been called or contacted. He added that he is the
Vice President of the Parkview Gardens association but did not attend any of the meetings; Mr.
Geiger and Mr. Lutske attended the meetings. He stated that in the past 10 years there had been
other plans for the parking lot and he could only assume that the City was using this plan to
sneak this proposed use in. He stated that what is going on now is negative with business owners
and property owners fighting over the use of this land. He stated that removing this part of the
Plan would not stop the Plan and he would like to take it out of the Plan and the LSBD would
also like it removed from the Plan.

to completely remove
any reference to condos and a parking structure on the parking lot north of Delmar.

Mr. Wald stated that he built Market in The Loop in the 1980s and was told that parking would
be free surface parking. He stated that if it was developed it would kill The Loop. He added that
there are other places to develop and suggested it be taken out.

Ms. Lewis asked Mr. Wald if in the past 9 months he received any notification about the Plan.

Mr. Wald stated that the City stated they sent notification and the notification stated there was a
plan for Parkview Gardens. He stated he arranged with Mr. Geiger and Mr. Lutsky that they
attended those meetings. He stated he knew there was a plan but never received a notice about a
proposed change in the zoning and use of the property. He added that when there was a
proposed new restaurant, he received notice about it and here is a situation where there is a
proposed change in the zoning and use of the property and he should have received notice.

Ms. Lewis asked, for clarification, if the method of communication was different from the
restaurant example and in this case he had received a general introduction about the Plan.

Mr. Wald stated that was correct, a general notice that there was a proposed Plan for Parkview
Gardens.

Ms. Lewis asked if that was the consensus of The Loop regarding communication about the Plan.

Mr. Wald stated that no property owner or business owner was notified about the proposed
change of the parking lot.

Mr. Halpert apologized that they did not receive notice.

tm; E
