Mr. Martin suggested to Council that he would give them a brief written explanation of why he
asked for a closed session and if they felt the need to discuss it farther then that would be fine.

Mr. Sharpe asked if he could withdraw his motion but did not because Ms. Carr added another legal
closed item to the agenda.

Mr. Kraft said we have been discussing Ms. Carr’s issue for the last 40 minutes and wondered what
they had to discuss in the closed session that was not discussed already in the public.

Mr. Crow suggested having the closed session at a later date since the closed session was for one
item and one was added at the last minute, but out of respect for his colleague, if she felt strongly
about it, then they would do it now.

Ms. Carr stated that the reason she asked to add to the agenda and closed session under legal
was because it came out yesterday evening and needed to be addressed immediately and that
there were some issues that they have not discussed in the Council meeting that was more
sensitive. She said she was willing to postpone the first discussion, but not willing to postpone her
request.

Mr. Glickert stated that he would keep the motion of going into closed session if Ms. Carr deemed if
necessary.

Ms. Carr stated yes.

Mr. Kraft stated as a matter of principle that he appreciated that Mr. Martin gave the Council
information as to what the session entailed and that he offered to give a legal memo of why it
needed to be confidential instead of public. He stated he did not get the same memo from Ms. Carr
so he did not have a clue as to why Council was going into closed session, so he would vote
against it.

Ms. Carr stated that the Council has some things to talk about with regard to the release of
confidential legal documents and some of those things she believed should be discussed with the
City Attorney in a confidential manner. She apologized to Mr. Kraft that he did not receive a notice,
but she got her notice of the release of the documents after 6:00 p.m., Sunday.

Roll call was:
Ayes: Mr. Price, Ms. Carr, Mr. Crow, Mr. Glickert, Mr. Sharpe and Mayor Welsch
Nays: Mr. Kraft

The closed session passed by a majority vote.

Q. ADJOURNMENT

Mayor Shelley Welsch adjourned the meeting at 8:06 p.m.

Respectfully submitted,

Joyce Pumm
City Clerk, MRCC/CMC

13
