<br />Mr. Kraft stated that Congress should make no law abridging the freedom of <br />speech as stated in the First Amendment of the Constitution. He stated that this <br />discussion was a blatant bullying attempt to use the Sunshine Law to limit political <br />free speech. Mr. Kraft noted Council Comments are routinely presented without <br />an agenda. He noted that what he discussed was clearly related to the rules of <br />this Council. Mr. Kraft said no one has suggested that the Council comments do <br />not meet the Sunshine Law. He stated the Sunshine Law is to maximize <br />openness and transparency and does not limit the free political speech of any <br />Council or member. Mr. Kraft suggested for all the attorneys and pseudo- <br />attorneys that any attempt to limit or restrict political speech would be overruled <br />by 200 years of Supreme Court decisions. He stated the Sunshine Law does not <br />limit the speech of an individual Councilmember or the Council. Mr. Kraft noted <br />that it does limit some of the votes and actions that Council can take; requires all <br />items to be voted upon, be part of the agenda, and must be published 24-hours <br />before the meeting. He noted the items discussed at the last meeting resulted in <br />no votes and no actions by Council. Mr. Kraft stated the discussion now is a <br />blatant, bullying attempt to abuse the Sunshine Law, to limit the speech of an <br />individual Councilmember and has abused the intent and the letter of the <br />Sunshine Law. <br /> <br />Mr. Price ask for a Point of Clarification to the Chair, he had estimated as to how <br />long Mr. Kraft spoke and he was a minute short, so asked if he would get to talk if <br />Mr. Kraft talked 11-1/2 minutes for 11-1/2 minutes so his freedom of speech <br />would not be denied. He asked if that was yes-or-no for free speech. Mayor <br />Welsch noted the clock was running. Mr. Price said before Mr. Kraft calls a Point <br />of Order which he was getting ready to do, as usual; he was so predictable. Mr. <br />Kraft said he was not doing eleven minutes now but needed to know in the future, <br />since Mr. Kraft got eleven can he get eleven. Mayor Welsch noted that she <br />would do it when the time came as he has had longer than eleven minutes in the <br />past and as she said the last time, he will probably have longer than eleven <br />minutes in the future. Mr. Price asked for a Point of Clarification from the Chair <br />asking when Mr. Kraft interrupts him when he makes a point as it relates to the <br />residents, if Mr. Kraft can be told he is out-of-order because he is prohibiting my <br />right to free political speech. Mayor Welsch stated she would call any member <br />out-of-order if they were out-of-order. Mayor asked him to continue. Mr. Price <br />said he needed to be clear that he will get his eleven minutes and when Mr. Kraft <br />rudely interrupts his free political speech, that the chair would exercise her <br />authority to stop him because today he is a proponent of free speech, when it is <br />him, but when it is a specific colleague; he is against their free speech. He said <br />to his colleague, he cannot have it both ways and can’t play a game when the <br />shoe is turned and Mr. Kraft has his prepared text about free speech but he is <br />against other people’s rights of free speech. <br /> <br />Ms. Carr stated in Council Comments they are free to say anything they want and <br />does not have to be put on the agenda. She noted the addition came in the <br />Council Reports and Business which does have to be placed on the agenda and <br />normally has to have a second. Ms. Carr told Mr. Kraft that in now way would <br />she seek to limit his right to free speech; however Mr. Kraft misrepresented the <br />topic.
