<br />Mayor Welsch stated that the question was called and seconded by Ms. Carr. <br /> <br />Mr. Kraft asked if someone could read the motion again to which Ms. Pumm read <br />the motion on the floor. <br /> <br />Mayor Welsch asked for a roll call on the Call for the Question <br /> <br />Roll call vote was: <br />Ayes: Mr. Price, Ms. Carr, Mr. Crow, and Mr. Sharpe <br />Nays: Mr. Glickert, Mr. Kraft and Mayor Welsch <br /> <br />Call for the question failed as it requires a 2/3 majority vote. <br /> <br />Mayor Welsch asked that all those in favor of the motion as stated by Ms. Carr to <br />signify by saying aye. The motion carried by a majority with Nays from Mr. <br />Glickert and Mayor Welsch. <br /> <br />M. UNFINISHED BUSINESS <br /> <br />BILLS <br />Bill 9178 <br />1. – An ordinance amending Title 9 “Public peace, morals and welfare,” <br />Chapter 9.08 “Offenses against public peace and decency: of the Municipal Code of <br />University City by enacting a new section relative to protests at funerals. <br /> <br />Bill 9178 was given its second and third reading <br /> <br />Mr. Sharpe moved for approval and was seconded by Mr. Price. <br /> <br />Mr. Kraft stated that he was going to vote for this ordinance, but felt it was important <br />to explain the ordinance. He said the ordinance was a response to the activities of <br />the Westboro Baptist Church. He said members of the church frequently protest at <br />funerals of soldiers with signs featuring messages like “Thank God for dead soldiers” <br />and “Thank God for 911” claiming the deaths were God’s punishment for American <br />immorality and tolerance of homosexuality. He said that this law would not prohibit <br />the protest of the Westboro Baptist church, but would require that the protest to be <br />300 feet away from a funeral or burial. He said to his understanding the Westboro <br />Baptist Church plans to abide by the 300 feet restrictions. <br /> <br />Mayor Welsch stated that her instinct was not to proactively vote to limit the rights of <br />free speech. She has checked with Mr. Walker, though, who said that the City <br />Attorney stated that the 300 feet exclusion has been upheld by the courts, so she <br />would support this bill. <br /> <br />Mr. Sharpe stated that he was the one who asked Mr. Walker to put this bill on the <br />agenda and that he was very supportive of this issue. <br /> <br />Roll call vote was: <br />Ayes: Mr. Price, Ms. Carr, Mr. Kraft, Mr. Crow, Mr. Glickert, Mr. Sharpe and Mayor <br />Welsch <br />Nays: none <br />13 <br /> <br /> <br />
