Ms. Carr <br />stated she did not think she would be capable of doing that and was not sure if <br />the Army Corp of Engineers would want her down there messing around with <br />the channel. She continued reading from the MSD letter, “As provided in its <br />storm water ordinance.” The December 15, 2006, letter to City Attorney John <br />Mulligan MSD would remove channel obstructions as necessary. Ms. Carr <br />stated in the end we are going to have to help ourselves. Perhaps the water- <br />shed coalition can help in some of the neighborhoods, where Ms. Fried said <br />they were monitoring that Mona section, which has all kinds of trash and <br />obstructions and things from the last flood are still there. Ms. Carr noted she is <br />still concerned about the people whose homes are flooded every single time the <br />water breaches the banks. <br /> <br />Mr. Price said it took him awhile to find this document, but he wished the Mayor <br />would have told him she had it. Mayor Welsch replied that it was distributed <br />three years ago. Mr. Price stated in this document which went back to 1954, <br />MSD was created and charged with cleaning up the River des Peres. He noted <br />nd <br />that he came on Council in 1986, for the first time and people that lived on 82 <br />Street; their yards were falling into the River des Peres to the point where some <br />had no back yards. Danforth made a promise to get the funding to build the <br />nd <br />walls on 82 street and kept it. In 1986, MSD was involved in channel <br />improvements at the Pennsylvania Bridge; in 1988, the kick-off on the issues on <br />nd nd <br />82Street; in 1990 improvements down-stream on 82Street; in 1994 there <br />ndth <br />were improvements on 82 Street; in 2003, improvement on Mendell & 79and <br />in 2004 many more were completed by MSD. MSD played an active role in all <br />the repairs in the River des Peres. Mr. Price stated that if he went and cleaned <br />out debris in the River des Peres he would be giving MSD the excuse to <br />advocate their responsibility. Mr. Price stated that MSD is saying they play no <br />role and if one accepts this, then you gave MSD ammunition to advocate theirs <br />responsibility. Mr. Price’s asked the City Manager if the current City Attorney <br />could look at exploring what avenues the City may have in regards to MSD and <br />see if other cities that back up to the River des Peres would be interested in <br />looking at what alternatives the cities have as related to MSD and their <br />responsibility. <br />Mr. Walker said they would work with the attorney and comeback to advise the <br />Council with respect to what options there are to legally pursue. <br />Mr. Price asked the City Manager to contact other municipalities to see what <br />interest they may have and asked how long that would take. <br />Mr. Walker said the City should be able to come back with a report in early <br />October. <br />12 <br /> <br /> <br />
