Mr. Ollendorff said Building and Occupancy Code <br />requirements will be used, and penalties for noa-cu~uliance with those <br />as well as th~ subdivision ordinance my be <br /> <br />Mr. Cottc~ said be has not =~_~n ~ that ~m~antees that the developer <br />will do any more than be has alrea_ay d~le. He felt the residents ~ assur- <br />e bey~ld written c~ments f~L~ the develol3er, and that the City should <br />retain the e~uw requi, ~Lent. He asked for clarification as to what tba de- <br />veloper has px~-,,~ed. Mr. Ollendorff said the City has a pledge, not a guar- <br />antee, that certain things will be dc~e; there are penalties that will apply <br />if the pledge is not carried cut. <br /> <br />Mrs. ~ said the developer has p~umised in writing to put aside several <br />hundred dollars per house to be sold that will be tied to i~provenents for <br />Plats 1, 2, and 3; he is also pledging in writing that the re~i~s in those <br />plats will he cu~uleted by May 31, 1995, conditic~ed on how quickly the henes <br />sell and the revenue becem~ available. She no~a the City Manager sent a <br />memo to Council recently that flood elevation certifications for finished <br />houses have been c~leted, and an owner called her to ask if they will re- <br />caive a copy of the paperwork. Mr. 011endorff said tba certificates were for <br />Plats 1, 2, and 3, and ell required information has been suhnitt~9_ to federal <br />officials; even~m]ly, bnm~wners will he advised. <br /> <br />Mr. Scbacmer said his goal has always been to get this project c~uleted; it <br />is cl~v to him that cont/maation of the esu~uw will prevent that f~ hap- <br />pening. He felt through diligent attention to the de~{]s e~l~m{t~t by resi- <br /> <br />the intarests of both the residents and the City will he ma~. <br /> <br />All voted Aye ex~ C~uncilmember Cotton, who votea_ May.
