But after researching it further, <br />he found out that this amount included much more extensive work than just painting, which is <br />something he believed Council should have known about. <br /> <br />Mr. Crow asked Mr. Walker if he could explain what specifications the lowest bidder had failed to <br />provide. Director of Public Works & Parks Richard Wilson stated that the low bidder had not met <br />the specifications because his bid included two coats of paint versus the three required and power <br />washing instead of sandblasting. <br /> <br />Voice vote on Mr. Sharpe’s motion carried unanimously. <br /> <br />2. <br />Approval of award to West Fall Hauling Inc. in the amount of $28.255.00 for the sidewalk and curb <br />replacement project at various locations. <br /> <br />Mr. Sharpe moved to approve, seconded by Mr. Glickert and the motion carried unanimously. <br /> <br />3. <br />Approval of award to Raineri Construction in the amount of $425,124.50 for the sidewalk and curb <br />replacement project at various locations. <br /> <br />Mr. Glickert moved to approve, seconded by Mr. Sharpe and the motion carried unanimously. <br /> <br />4. <br />Approval of extension for the Conditional Use Permit for The Loop Trolley. <br /> <br />Mr. Walker stated that Staff is recommending a six-month extension of the C.U.P. for the Loop <br />Trolley, and that in the past Council had approved this (C.U.P. for the Loop Trolley) unanimously <br />He stated that a denial of this request would require the applicant to go through the entire permit <br />process all over again, delaying the project for a considerable length of time. <br /> <br />Mr. Sharpe questioned what impact, if any, a denial would have on the completion of this project. <br />Mr. Walker stated that it would probably add another six months to the completion date, because <br />the applicant would have to reapply and get approvals from the Plan, Traffic and Historic <br />Preservation Commissions. <br /> Mr. Sharpe asked whether a denial would have any impact on the Federal Government <br />approving this project. Chris Poehler, District Administrator for the Loop Trolley Transportation <br />Development District (TDD), appeared before Council and stated that although he could not speak <br />for the Federal Government, the government has already approved the project and has released <br />funds in order to complete the design phase and hire a construction manager. However they have <br />requested a verification of cost estimates, a project schedule and manuals, prior to the release of <br />additional construction funds. He stated that all of these documents are in final review and the <br />expectation is that they will be approved within a few weeks and the District can start advertising for <br />construction in April. Mr. Poehler stated that the Federal Government had expressed concerns in <br />the past due to the project’s lack of progress and even threatened to take back the grant. So his <br />assumption is that a six-month delay would not be a positive thing in their eyes. <br /> <br />Mr. Crow advised Mr. Poehler that Council was basically working off of a one paragraph letter <br />which stated, “This period of time will allow adequate time to resolve all outstanding issues”. He <br />then asked Mr. Poehler how many outstanding issues needed to be resolved. Mr. Poehler stated <br />that as far as the FTA is concerned the only remaining issues are the cost estimates and manuals, <br />which should be complete by the end of this week. He stated that everything else has been <br />submitted and to date they have not received any significant comments in response. Mr. Crow <br />asked Mr. Poehler if he could remember how many outstanding issues there were the last time <br />Council approved a request for an extension. Mr. Poehler stated he was not aware of a previous <br />extension and that was before he was on the project. Mr. Crow stated that in his opinion it is a little <br />difficult for Council to make a sound decision based on one paragraph. <br /> <br />Mr. Glickert stated that this has been on-going for twelve months and concurred with the comments <br />made by Mr. Crow.
