Session 1530, Minutes Page 4 <br /> October 15, 1990 <br /> Li , <br /> have spent more than $2,000 to ascertain that building a home there is feasi- <br /> ble. They plan to use as little land as possible for the hoarse and leave the <br /> major portion in its natural state. He felt his background in art and design <br /> should help convince neighbors that an esthetically pleasing hoarse that fits in <br /> the neighborhood will be built. Mrs. Thompson suggested that the Mays, their <br /> neighbors, and city authorities meet to discuss this matter. Mrs. May noted <br /> there were no trustee or other requirements for what the structure must look <br /> like, and she asked Mrs. Thompson if she was suggesting the Mays do this as a <br /> courtesy. Mrs. Thompson said she was. Mrs. May pointed out that any neighbor <br /> who had concerns about this matter could easily have called them for informa- <br /> tion, but no one did. She also noted they have followed the City's guidelines <br /> for this procedure completely. They also contacted Mr. Hill since it was <br /> their understanding that when a property is vacated, the people involved in <br /> the decision to vacate are the adjacent owners, and the only person so affect- <br /> ed is Mr. Hill. Mr. Price asked if the requested vacation would result in ac- <br /> cess to the proposed home. Mr. 011endorff said that was not clear to him--the <br /> staff initially opposed the vacation of the right-of-way because they thought <br /> that would prohibit any development. He suggested that the matter be referred <br /> back to the staff for more detailed study. He pointed out there is a public <br /> right-of-way there now; if vacated, he did not understand how anyone could get <br /> back to the property if there is no longer a street. Mrs. May said the couple <br /> was now in the process of buying the only parcel of land at this location that <br /> would be landlocked should the vacation take place; therefore, no one else <br /> will be affected. <br /> Mr. Eric Stein, 7427 Chamberlain, said a house built at this location will be <br /> about 150 feet from his property, and he was concerned about the effect of <br /> construction downstream. <br /> Mr. Derrick Coley, 7366 Drexel, said it was evident there was a strong neigh- <br /> borhood feeling against any development of this property. He said he would be <br /> disappointed if this land was developed and the natural beauty lost. <br /> Mr. David Mazza, 7405 Chamberlain, said he was told when he moved in that the <br /> property behind him could not be developed because there was no access to it, <br /> and he felt it should stay that way. He also said that the 1978 flood plain <br /> map shows that all the property behind his home is in the flood plain. <br /> Mr. Miles Cramer, 1065 Jackson, said his home was south of the area in ques- <br /> tion, and he supported Mr. Mazza's statement regarding the flood plain because <br /> he was informed he would have to continue flood insurance even though his land <br /> is higher than any other in the area. He said the Council should determine <br /> whether the property is in the flood plain. <br /> Ms. Stephanie Huddleston, 1051 N. Jackson, asked how traffic will get into <br /> this street if it is vacated. Mr. 011endorff repeated he was not sure what <br /> happens if the City vacates the street, and the staff needed to study this. <br /> Ms. Huddleston felt it was a bad precedent for the City to vacate property for <br /> someone's personal use. <br /> (me Mr. Tarn Edmondson, 7366 Chamberlain, said perhaps the Mays were sincere about <br /> not changing the natural area, but he was concerned about what might happen if <br />
