Mr. Munkel seconded the motion. <br /> <br />Responding to Mr. Lieberman, Mr. Ollendorff said that this would allow <br />construction on Sundays, where in the past it was not allowed. Mr. Ollendorff <br />said that the current law lists no time restrictions for allowing construction work. <br />Mr. Ollendorff said that he believes this is outdated, but we do want to add <br />overnight restrictions seven days a week. Mr. Lieberman wondered if this new <br />wording will be too restrictive for companies that want to do overnight work. Mr. <br />Ollendorff said that there is a provision in the ordinance that was left unchanged <br />that gives the city management the authority to permit work during these <br />restricted hours if shown that there is a special need for it. <br /> <br />Mr. Munkel believes that this wording is a bit of an infringement on businesses, <br />especially in the summer, when construction normally starts very early and ends <br />early, when the weather is dangerously hot. He thinks there should be some <br />leeway allowed. He thinks, in general, that these new restrictions are a good rule. <br /> <br />Mr. Sharpe said that he is opposed to construction on Sundays, and asked if this <br />was requested by a citizen or group of citizens. Mr. Ollendorff said that he <br />personally suggested this change. It was not suggested by anyone else. He is <br />more interested in getting the overnight restrictions. It is up to Council, whether <br />not Sunday is kept restricted or not. <br /> <br />Mr. Schoomer wonders why we should define the day of rest as Sunday - why not <br />Saturday, the Jewish day rest or a Friday. Mr. Sharpe said that the citizens <br />should have one day of peace from construction noise. The day does not matter. <br /> <br />Mr. Munkel said that he believes that this would be mostly for businesses, but <br />could see this applying to citizens, as well. The weekend is the time that most <br />people have free to work on their homes. He believes the Sunday restriction <br />should be removed. <br /> <br />Mr. Wagner agrees with Mr. Sharpe on this and without giving a religious <br />connotation, which does not have to be done, the citizens do deserve one day of <br />the week when there is not any construction noise in their neighborhoods. He <br />believes the Sunday restriction should be kept and give the City Manager the <br />discretion to allow it under special circumstances, but not give carte blanche <br />approval seven days a week. <br /> <br /> <br />
