NOTICE OF CHARTER AMENDMENT ELECTION <br /> <br />CITY OF UNIVERSITY CITY, <br />ST. LOUIS COUNTY, MISSOURI <br /> <br />NOTICE is hereby given that a special election will be held in <br />the City of University City, St. Louis County, Missouri, on <br /> <br /> Tuesday, the 6th day of April, 1976 <br /> <br />for the purpose of submitting to the qualified electors of said <br />City the following amendments to the City Charter: <br /> <br />PROPOSITION NO. 1 <br /> <br />Article II, Section 6, is hereby amended by striking the refer- <br />ence to "public office" therein and substituting in lieu thereof <br />the phrase "popularly elected office ,"in describing a disquali- <br />fication from continuing in office as a councilman, by providing <br />that no councilmen shall hold any other compensatory position in <br />the city government during their terms by providing cessation of <br />residency in the city or the ward from which listed, and conviction <br />of a felony, malfeasance in office, bribery, or other corrupt <br />practice shall cause a councilman's office to immediately become <br />vacant, so that said section as so amended, shall read as follows: <br /> <br />A councilman shall be a qualified voter of the city <br />and shall have been a resident thereof for at least <br />three consecutive years inm~ediately prior to his <br />election. Councilmen elected by wards shall be re- <br />sidents of the wards from which elected. Councilmen <br />shall hold no other popularly elected public office <br />nor shall they hold any other compensatory position <br />in the city government during their terms. If a <br />councilman shall cease to be a resident of the City <br />of University City or the ward from which elected, or <br />shall cease to possess any of the above qualifications, <br />or shall be convicted of a felony, malfeasance in <br />office, bribery, or other corrupt practice, or of a <br />crime involving moral turpitude, the councilman's <br />office shall immediately become vacant. <br /> <br />PROPOSITION NO. 2 <br /> <br />Article II, Section 12, is hereby amended by striking the wo~d <br />"substantial" preceding the phrase "personal or private interest," <br />by providing for the alternative of a councilman revealing the <br />existence of an interest in any measure or bill pending before <br />the Council and abstaining from voting, by eliminating the re- <br />ference to the conflict of interest provisions of the Statutes <br />of Missouri, and by inserting the word "wilfully" in describing <br />a violation of this section, so that said section as so amended, <br />shall read as follows: <br /> <br />(1) Except for the purpose of inquiry, the council <br />and its members shall deal with the administrative <br />officers and the city employees solely through the <br />city manager. Neither the council nor any of its <br />members shall give orders to any subordinate of the <br />city manager, either publicly or privately. Neither <br />the council nor any of its members shall direct or <br />request the appointment of any person to, or removal <br />from, office by the city manager or any of the city <br />manager's subordinates, or in any manner take part <br />in the appointment or removal of officers and employ- <br />ees in the administrative service of the city. <br /> <br />-3- <br /> <br /> <br />
