(2) If any councilman or the mayor has a personal <br />or private interest in any measure or bill pending <br />before the council, that person shall reveal the <br />existence of an interest and abstain from voting <br />or file a written report of the nature of the in- <br />terest with the city clerk prior to passing on the <br />measure or bill. <br /> <br />(3) Any person who wilfully violates the requirements <br />of this section shall forfeit his office and in addi- <br />tion thereto shall be guilty of a misdemeanor, and <br />upon conviction thereof in any court of competent <br />jurisdiction shall be subject to a fine not exceeding <br />one thousand dollars. <br /> <br />PROPOSITION NO. 3 <br /> <br />Article II, Section 15, is hereby amended by striking the last <br />sentence of said section, providing that "all meetings of the <br />council shall be open to the public," so that said section as <br />so amended, shall read as follows: <br /> <br />The council shall meet regularly at such times as <br />may be prescribed by its rules, but not less frequently <br />than once each month. <br /> <br />PROPOSITION NO. 4 <br /> <br />Article III, Section 19, is hereby amended by deleting subparagraph <br />(5) thereof which provides that the city manager shall serve as <br />director of one department, and, with the consent of the council, <br />serve as the director of two or more departments, so that said sec- <br />tion as so amended, shall read as follows: <br /> <br />The city manager shall be the chief administrative officer <br />of the city and shall be responsible to the council for <br />the proper administration of all the city's affairs. To <br />that end he shall have power and shall be required to: <br /> <br />(1) City officers and employees. Appoint, and when <br />necessary for the good of the service, remove all officers <br />and employees of the city except as otherwise provided by <br />this Charter; <br /> <br />(2) Annual budget. Prepare the budget annually and submit <br />it to the council and be responsible for its administration <br />after adoption; <br /> <br />(3) Annual report. Prepare and submit to the council, as <br />of the end of the fiscal year, a complete report on the <br />finances and administrative activities of the city for the <br />preceding year; <br /> <br />(4) Advice, etc. to council. Keep the council advised of <br />the financial condition and future needs of the city and <br />make such recommendations as may seem to him desirable; <br /> <br />(5) Enforcement of laws, etc. Enforce all laws and ordinances <br />and see that all contracts and franchises are faithfully <br />performed; <br /> <br />(6) Additional duties. Perform such other duties as may <br />be prescribed by this Charter or required of him by the <br />council, not inconsistent with this Charter. <br /> <br />-4- <br /> <br /> <br />
