Section 13. ~peciftc Standards fo; Flood Hazard Reduction. <br />In all areas of special flood hazards where base flood elevation data has <br />been provided as set forth:. .. <br /> <br /> (1) ~esidential Construction - New construction or substantial improve- <br /> ment of any residential building shall have the lowest floor,-in- <br /> cludinq basement, elevated to one',¢oo(F, or'[mor~ abevet6ase flood <br /> elevation. · . <br /> (2) Non-residential Construction - New construction or substantial tm- <br /> provementof any comnercial, industrial or other non-residential <br /> structure shall either have the lowest floor, including basement, <br /> ~)evated to one foot above the level of the base flood evevation, <br /> or together with attendant utility and sanitary facilities, be <br /> floodproofed so that below the base foood level the structure is <br /> water tight with walls substantially impermeable to the passage <br /> of water and with structural components having the capability of <br /> resisting hydrostatic and hydrodynamic loads and effects of buoyancy. <br /> A registered professional engineer or architect shall certify that <br /> the standards of this subsection are satisfied. <br /> <br /> (3) Floodways - Located within areas of special flood hazard <br /> established inSection 3 are areas designated as floodways. Since <br /> the floodway is an extremely hazardous area due to the velocity of <br /> flood waters which carry debris, .potential projectiles and erosion <br /> potential, the following provisions shall apply; <br /> <br /> '(al Prohibits encroachments, including fill, new construction, <br /> substantial improvements and other developments unless certi- <br /> fication by a professional registered engineer or architect <br /> is provided demonstrating that encroachments shall not result in <br /> any increase velocity or in flood levels during occurence of the <br /> base flood discharge. <br /> <br /> (b) If Sectio~ 13.,Sub,Section 3(a)is satisfied, all new construction <br /> and substantial improvement~ shall comply with all applicable <br /> flood hazard reduction provisions of Section '12 and 13. <br /> <br />Section 14. Standards for Subdivision Proposals for Flood Hazard Reduction. <br /> <br />(1) All subdivision proposals shall be consistent with the need to <br /> minimize flood damage. <br /> <br />{2) All subdivision proposals shall have public utilities and faci- <br /> lities such as sewer, gas, electrical and water systems located <br /> and constructed to minimize flood damage. <br /> <br />(3) All subdivision proposals shall have adequate drainage provided <br /> to reduce exposure to flood hazards. ~ <br /> <br />{4) Base flood elevation data shall be provided for subdivision <br /> proposals and other proposed development which is greater than <br /> the lesser of $0 lots or 5 acres. <br /> <br />Section 15. Non-Conforming ~e. <br /> <br />(1) A structure or the use of a structure or premises which was <br /> 'lawful before the passage or amendment of the ordinance, <br /> but is not in conformity with the provisions of this <br /> ordinance may be continued subject to the following <br /> conditions: <br /> <br />(a) No such use or substantial improvement of that use <br />shall be expanded, changed, enlarged, or altered in a way <br />which increases its non-conformity.. <br /> <br />(b) If such use is discontinu&d for 12 consecutive months, <br />any future use of the building premises shall conform to <br />this ordinance. <br /> <br />-7- <br /> <br /> <br />
