(2) If any non-conforming use oh structure is destroyed by any means, <br /> including flood, it shall not-be reconstructed if the cost is <br /> more that 50 per cent of the market value of the structure before <br /> the damage occurred excep~ that if it is reconstructed tn con- <br /> formity with the provisions of this ordinance. This limitation <br /> does not include the cost of any alteration to comply with <br /> existing State or 1Dca] health, sanitary, building, or safety <br /> codes or regulations or the cost of any alteration of a structure <br /> listed on the National Register of Histroic Places or a State <br /> Inventory of Historic Places. <br /> <br />Section 16. Penalties for Violation. <br /> <br />Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided <br />in Chapter 1, Section 1-8 of the r.lunicipal Code of the City of University <br />City. <br /> <br />Nothing herein contained shall prevent the City of University City or other <br />appropriate authority from taking such other lawful action as is necessary <br />to prevent or remedy any violation. <br /> <br />Section 17. Amendments. <br /> <br />The regulations, restrictions, and boundaries set forth in this ordinance <br />may from time to time be amended, supplemented, changed or appealed to <br />reflect any and all changes in the National Flood Disaster Protection Act <br />of 1973, provided, however, that no such action may be taken until after <br />a public hearing in relation thereto, at which parties in interest and <br />citizens shall have an opportunity to be heard. At least 15 days notice <br />of time and place of such hearing shall be published in a newspaper of <br />general circulation, the St. Louis Countian. The regulations of this <br />ordinance are in compliance with the National Flood Insurance Program <br />Regulations as published in the Federal Register, Volume 41, Number 207, <br />dated October 26, 1976. <br /> <br />Section 18. Effective Date. <br /> <br />This ordinance shall take effect and be in force from and after June 1,1978, <br />the effective date of the Flood Hazard maps incorporated herein and made <br />a part hereof. <br /> <br />PASSED this 8th day of <br /> <br />ATTEST: <br /> <br />Iv[ny,..--..., 1978. <br /> <br />CERTIFIED TO BE CORRECT AS TO FORM: <br /> <br />CITY COUNSELOR <br /> <br />-8- <br /> <br /> <br />
