ARTICLE II. CATV SYSTEM EXTENSION, OPERATION, STANDARDS AMP PROCEDURES <br /> <br />Section 1. Service Availability and Record Request <br /> <br />The Company shall provide cable television service throughout the <br /> <br />entire franchise area pursuant to the provisions of this franchise and shall <br /> <br />keep a record for at least three (3) years of all requests for service received <br /> <br />by the Company. This record shall be available for public inspection at the <br /> <br />local office of the Company during regular office hours. <br /> <br />Section 2. CATV System Construction <br /> <br />a) CONSTRUCTION TIMETABLE <br /> <br />1. The Company shall submit system design maps to the <br />City within sixty (60) days of the final passage of the <br />franchise ordinance and be substantially complete in <br />construction within eight (8) months of the date of its <br />obtaining all necessary pole and permit clearances. The <br />Company shall submit all information required by the <br />utility companies for pole clearance within thirty (30) <br />days of the final passage by the Council of the fran- <br />chise ordinance. <br /> <br />2. The Company may propose a timetable of construction <br />which will make cable television service available <br />sooner than the above minimum requirements, in which <br />case such amendment will be incorporated by reference <br />pursuant to Article I, Section 4 of this ordinance, and <br />will be binding upon the Company. <br /> <br />3. Any delay beyond the terms of this timetable, unless <br />specifically approved by the City Council which approval <br />shall not be unreasonably withheld, will be considered a <br />violation of this ordinance, for which the provisions of <br />either Section 5 or Section 6 of Article III shall <br />apply, as determined by the City. <br /> <br />4. Nothing in this Section shall prevent the Company <br />from constructing the system earlier than planned. <br /> <br />5. Construction in accordance with the plans submitted <br />by the Company shall commence as soon after the grant <br />and acceptance of the franchise as is reasonably <br />possible. The City acknowledges the commencement of <br />construction depends in a large part upon the Company's <br />retention of cable television construction crews and <br />pole rearrangements. The Company shall seek to <br />negotiate with utilities and to obtain and contract with <br />construction crews with all due diligence. Failure to <br />proceed expeditiously shall be grounds for revocation of <br />this franchise. Failure to proceed expeditiously shall <br />be presumed in the event construction is not sub- <br />stantially in compliance with the construction timetable <br />as set forth in this Section. <br /> <br />b) NEW DEVELOPMENT UNDERGROUNDING <br /> <br />In cases of new construction or property development where <br /> <br />17 <br /> <br /> <br />
