Nothing herein, however, shall prevent the Company from <br />voluntarily making such improvement or upgrading of its <br />cable system as it shall from time to time decide to <br />effect. <br /> <br />3. The City shall have the right to require the Company <br />to incorporate into its cable system, within a reason- <br />able time, any service which the Company is offering to <br />its subscribers in any one cable system in the City of <br />St. Loeis and the St. Louis County area (excluding <br />services which the Company may be testing on a limited <br />basis), provided however that any said requirements of <br />the City to the Company shall be subject to the terms <br />and conditions of paragraph 2 preceding and provided <br />further that any service incorporated by the Company in <br />newly constructed systems in the City of St. Louis and <br />the St. Louis County area which are not required by this <br />franchise to be offered in University City shall <br />promptly upon request of the City be provided by the <br />Company and not be subject to provisions of paragraph 2 <br />preceding. In this connection, the installation of <br />TOCUM 55+ in the City of Overland by the Company shall <br />be considered as on a trial basis for an initial five <br />(5) years period~ thereafter if said service is in <br />existence, the City may request the Company to incorpo- <br />rate it in the University City system subject to <br />paragraph 2 preceding. <br /> <br />g) STATION CABLECASTING CAPABILITIES <br /> <br />The Company shall construct within the City a high quality studio <br /> <br />facility dedicated for access programming. This studio shall be separate from <br /> <br />the facilities used by the Company for local origination, although it may be <br /> <br />housed in the same building. Main studio equipment may be used in the public <br /> <br />access studio or off premises as circumstances dictate by qualified users, such <br /> <br />as public school employees. In addition, mobile and portable video facilities <br /> <br />shall be provided and housed within University City.
