d) REGIONAL EDUCATIONAL AND CULTURAL ACCESS CP~NNELS <br /> <br />1. The Company shall maintain at least three (3) desig- <br />nated channels for use at no charge by regional <br />educational and cultural authorities. Fnl] time inter- <br />connection from a technical center designated by the <br />City is to be provided by the Company at no cost to the <br />City, and this interconnection shall meet the same <br />technical standards as the remainder of the Company's <br />system. <br /> <br />2. Until such time as there is demand for each cbanne] <br />full time (7:00 A.M.-11:00 P.~{., loc~l time) for its <br />designated use, public, local educational, government, <br />regional educational, and regional cultural channel pro- <br />gramming may be combined on one or more channels. To <br />the extent time is available therefor, access channels <br />may also be used for other broadcast and non-broadcast <br />services except that at least o~e channel shall be main- <br />tained exclusively for the presentation of access <br />programming. <br /> <br />e) TWO WAY CAPACITY <br /> <br />Any sysuem constructed shall meet or exceed the FCC requirements <br /> <br />for two-way cable casting. The Company shall agree to develop Class IV sig- <br /> <br />natures, as defined by the FCC, as soon as a demand by a reasonable number of <br /> <br />subscribers exist for two-way cablecasting; however, the Company shall not be <br /> <br />required to provide such service unless projected revenues from such service <br /> <br />shall equal or exceed the projected incremental costs of providing such <br /> <br />f) NEW DEVELOPMENTS <br /> <br />!. It shall be the policy of the Council to amend <br />liberally the franchise, upon application of the Com- <br />pany, when necessary to enable the Company to take <br />advantage of any development in the field of trans- <br />mission of television or radio signals which will afford <br />it an opportunity more effectively, efficiently or <br />economically to serve its customers. This section shall <br />not be construed to require the Council to make any <br />amendment changing its policy. <br /> <br />2. If the City determines, giving due regard to limita- <br />tion in technologies and economic reasonableness, that <br />any part or all of the cable system should be improved <br />or upgraded, including without limitation the increasing <br />of channel capacity, it may by ordinance order such rea- <br />sonable improvements or upgrading of the cable system by <br />the Compa~y, provided however, that said improvement or <br />upgrading of the Company's cable system shall not <br />require expenditures exceeding $900,000 in the aggregate <br />over the life of this franchise, and provided further <br />that said $900,000 shall consist of not ,~re that <br />$300,000 during each of the following three 2-year <br />periods from the effective date of this franchise: <br /> <br />1) From the sixth to the eighth anniversary $300,000 <br />2) From the eighth to the tenth anniversary $300,000 <br />3) From the tenth to the twelfth anniversary $300,000 <br /> <br />32 <br /> <br /> <br />
