3. 9~erating Rules for Leased Access Channels <br /> <br />(a) Leased access channel(s) shall be available for <br />access cablecasting to any person, group, organiza- <br />tion, or entity upon the filing of an appropriate <br />request therefor in accordance with Section 6 hereof° <br /> <br />(b) Leased access channel(s) shall be subject to <br />pre-emption by the Company for the purpose of pro- <br />viding public access cablecasting, educational <br />access cablecasting, or local originatioa cable- <br />casting. <br /> <br />(c) No program and/or presentation shall be cable- <br />cast or permitted to be cablecast on the leased <br />access channels which involves directly or indirect- <br />ly any lottery information or which involves a <br />lottery. Provided, however, that the rule shown in <br />Section 1 (d) above applies. <br /> <br />(d) When any access channel user presents any matter <br />for which money, service or other valuable consider- <br />ation is either directly or indirectly paid or <br />promised to, or charged or accepted by such access <br />channel user, at the time of the cablecast, the <br />channel user shall announce (i) that such matter is <br />sponsored, paid for, or furnished, either in whole <br />or in part, and (ii) by whom, or on whose behalf, <br />such consideration is supplied; provided, however, <br />that "service or other valuable consideration*' shall <br />not include any service or property furnished either <br />without or at a nominal charge for use on, or in <br />connection with, a cablecast unless it is so fur- <br />nished in consideration for an identification of any <br />person, product, service, trademark, or brand name <br />beyond an identification reasonably related to the <br />use of such service or property on the cablecast. <br />For the purpose of this Section, the term <br />"sponsored" shall be deemed to have the same meaning <br />as "paid for." <br /> <br />(e) Each access channel user shall exercise reason- <br />able diligence to obtain from its employees, and <br />from other persons with whom it deals directly in <br />connection with any matter for cablecasting, infor- <br />mation to enable such access channel user to make <br />the announcement required by Section 3 (d), (f) and <br />(h) herein. <br /> <br />(f) In the case of any political origination cable- <br />cast matter or any access cablecast matter involving <br />the discussion of public controversial issues for <br />which any film, record, transcription, talent, <br />script, or other material or service of any kind is <br />furnished, either directly or indirectly, to an <br />access channel user as an inducement for cable- <br />casting ~uch matter, an announcement shall be made <br />both at the beginning and conclusion of such <br />cablecast on which such material or service is used <br />that such film, record, transcription, talent, <br />script, or other material or services has been <br />furnished to such an access channel user in connec- <br />tion with the transmission of such cablecast matter; <br />provided, however, that in the case of any cablecast <br />of five minutes duration or less, only one such <br />announcement need be made either at the beginning or <br />conclusion of the cablecast. <br /> <br />39 <br /> <br /> <br />
