3. 9~erating Rules for Leased Access Channels (a) Leased access channel(s) shall be available for access cablecasting to any person, group, organiza- tion, or entity upon the filing of an appropriate request therefor in accordance with Section 6 hereof° (b) Leased access channel(s) shall be subject to pre-emption by the Company for the purpose of pro- viding public access cablecasting, educational access cablecasting, or local originatioa cable- casting. (c) No program and/or presentation shall be cable- cast or permitted to be cablecast on the leased access channels which involves directly or indirect- ly any lottery information or which involves a lottery. Provided, however, that the rule shown in Section 1 (d) above applies. (d) When any access channel user presents any matter for which money, service or other valuable consider- ation is either directly or indirectly paid or promised to, or charged or accepted by such access channel user, at the time of the cablecast, the channel user shall announce (i) that such matter is sponsored, paid for, or furnished, either in whole or in part, and (ii) by whom, or on whose behalf, such consideration is supplied; provided, however, that "service or other valuable consideration*' shall not include any service or property furnished either without or at a nominal charge for use on, or in connection with, a cablecast unless it is so fur- nished in consideration for an identification of any person, product, service, trademark, or brand name beyond an identification reasonably related to the use of such service or property on the cablecast. For the purpose of this Section, the term "sponsored" shall be deemed to have the same meaning as "paid for." (e) Each access channel user shall exercise reason- able diligence to obtain from its employees, and from other persons with whom it deals directly in connection with any matter for cablecasting, infor- mation to enable such access channel user to make the announcement required by Section 3 (d), (f) and (h) herein. (f) In the case of any political origination cable- cast matter or any access cablecast matter involving the discussion of public controversial issues for which any film, record, transcription, talent, script, or other material or service of any kind is furnished, either directly or indirectly, to an access channel user as an inducement for cable- casting ~uch matter, an announcement shall be made both at the beginning and conclusion of such cablecast on which such material or service is used that such film, record, transcription, talent, script, or other material or services has been furnished to such an access channel user in connec- tion with the transmission of such cablecast matter; provided, however, that in the case of any cablecast of five minutes duration or less, only one such announcement need be made either at the beginning or conclusion of the cablecast. 39
