u) "Installation" shall mean the connection of the system from <br /> <br />feeder cable to subscribers' terminals, and the provision of service. <br /> <br />v) "Local educational institution" means any not for profit educa- <br /> <br />tional institution approved and authorized by the City Council for use of the <br /> <br />Educational Access Channel. <br /> <br />w) "Local origination Channel" means any channel where the Company <br /> <br />is the only designated programmer, and provides video programs to subscribers. <br /> <br />x) "Monitoring" means observing a communications signal, or the <br /> <br />absence of a signal, where the observer is neither the subscriber nor the pro- <br /> <br />grammer, whether the signal is observed by visual or electronic means, for any <br /> <br />purpose whatsoever. Provided, monitoring shall not include systemwide or <br /> <br />individually addressed sweeps of the system for purposes of verifying system <br /> <br />integrity, controlling return paths transmissions, or billing for pay services. <br /> <br />y) "Obscenity" means that which, when considered as a whole, by <br /> <br />the average adult person, applying contemporary community standards: <br /> <br />(1) Predominately appeals to the prurient interest in sex; <br /> and <br /> <br />(2) <br /> <br />depicts, describes or portrays in a patently offen- <br />sive manner human sexual intercourse, sodomy, <br />bestiality, oral copulation, masturbation, urinary <br />and defecatory functions, sadism, masochism, sado- <br />masochistic abuse, lewd exhibition of the genitals or <br />any touching of the genitals, pubic areas or buttocks <br />of the human male or female, or the breasts of the <br />female, whether alone, or between members of the same <br />or opposite sex or between humans and animals in an <br />act of apparent sexual stimulation or gratification; <br />and <br /> <br />(3) when taken as a whole lacks serious social, literary, <br /> artistic, political or scientific value. <br /> <br />If the above definition of "obscenity" is for any reason held invalid or <br />unconstitutional by any Court of competent Jurisdiction then the following <br />definition of "obscenity" shall apply: <br /> <br />"Obscenity" means that which is of such a nature that <br />the average person, applying contemporary community <br />standards would find that the matter, taken as a <br />whole, appeals to the prurient interest, if the <br />matter depicts or describes, in a patently offensive <br />way, sexual conduct specifically defined by Missouri <br />law as obscene, and if the matter, taken as a whole, <br />lacks serious literary, artistic, political, or <br />scientific value. <br /> <br />z) "Pay television defined" is a fee subscriber system in which <br /> <br />the subscriber is charged a fee in excess of regular monthly subscription <br /> <br />service for the privilege of receiving a particular program or channel or <br /> <br />combination of programs or channels. <br /> <br /> <br />
