u) "Installation" shall mean the connection of the system from feeder cable to subscribers' terminals, and the provision of service. v) "Local educational institution" means any not for profit educa- tional institution approved and authorized by the City Council for use of the Educational Access Channel. w) "Local origination Channel" means any channel where the Company is the only designated programmer, and provides video programs to subscribers. x) "Monitoring" means observing a communications signal, or the absence of a signal, where the observer is neither the subscriber nor the pro- grammer, whether the signal is observed by visual or electronic means, for any purpose whatsoever. Provided, monitoring shall not include systemwide or individually addressed sweeps of the system for purposes of verifying system integrity, controlling return paths transmissions, or billing for pay services. y) "Obscenity" means that which, when considered as a whole, by the average adult person, applying contemporary community standards: (1) Predominately appeals to the prurient interest in sex; and (2) depicts, describes or portrays in a patently offen- sive manner human sexual intercourse, sodomy, bestiality, oral copulation, masturbation, urinary and defecatory functions, sadism, masochism, sado- masochistic abuse, lewd exhibition of the genitals or any touching of the genitals, pubic areas or buttocks of the human male or female, or the breasts of the female, whether alone, or between members of the same or opposite sex or between humans and animals in an act of apparent sexual stimulation or gratification; and (3) when taken as a whole lacks serious social, literary, artistic, political or scientific value. If the above definition of "obscenity" is for any reason held invalid or unconstitutional by any Court of competent Jurisdiction then the following definition of "obscenity" shall apply: "Obscenity" means that which is of such a nature that the average person, applying contemporary community standards would find that the matter, taken as a whole, appeals to the prurient interest, if the matter depicts or describes, in a patently offensive way, sexual conduct specifically defined by Missouri law as obscene, and if the matter, taken as a whole, lacks serious literary, artistic, political, or scientific value. z) "Pay television defined" is a fee subscriber system in which the subscriber is charged a fee in excess of regular monthly subscription service for the privilege of receiving a particular program or channel or combination of programs or channels.
