any defective work or materials for a period of one (1) year, commencing on the day of the acceptance by the City of the completed work, all in accordance with the plans and specifications on file. Section 3. The City Clerk is hereby directed to advertise for sealed bids in a regular weekly newspaper, of general circulation, published in the County of St. Louis, Missouri, by an insertion to appear at least ten (10) days prior to the date set for the opening of the bids, which will be received by him at his office up to ten-thirty (10:30) o'clock (C.D.T.) Thurs- day morning, the 21st day of July 1983, and then to be opened in the presence of the City Manager, who will award the contract to the lowest responsible bidder, subject to confirmation by the City Council. The City reserves the right to reject any and all bids. Each bid must be accompanied by cashier's ,or certified check on some bank or trust company in the County or City of St. Louis, or an acceptable bid bond, payable to the order of the City of University City, Missouri, in the sum of ONE-THOUSAND TWO HUNDRED DOLLARS \ ($1,200.00), as a guarantee that the successful bidder will, upon award being made, enter into the contract hereinafter provided for. The checks of the unsuccessful bidders shall be returned to them upon the rejection of their bids. Section 4. The successful bidder shall, within ten (10) days after notification of the award of the contract, file with the City Clerk a contract duly executed by him and the City, for furnishing the materials, labor and equipment and doing the work in accordance with the plans and specifications and, within the same period, .said bidder shall file with the City Clerk a good and sufficient bond in a sum equal to one hundred (100) per cent of the con- tract price with sureties to be approved by the City Manager, providing that he will carry out and comply with all of the terms and provisions of said contract, and will indemnify and hold harmless the said City of any claims whatsoever for damages arising out of alleged negligence of said contractor, his subcontractor, agents, servants or employees in connection with the per- formance of said contract. Upon his compliance with the provisions of this ordinance, the amount of the deposit which accompanied his original bid shall be returned to him; but should the said bidder fail to execute said contract 2
