BILL NO. <br /> <br />76O9 <br /> <br />INTRODUCED BY COUNCILMEMBER ADAMS <br /> ORDINANCE NO. 5405 <br /> <br />AN ORDINANCE RATIFYING AND CONFIRMING THAT THE LEWIS <br />CENTER REDEVELOPMENT AREA IS AN INSANITARY AND BLIGHTED <br />AREA, WHICH SHOULD BE REDEVELOPED IN THE P~LIC INTEREST; <br />APPROVING THE DEVELOPMENT PLAN ("PLAN") FOR THE LEWIS <br />CENTER REDEVELOP,_~ENT AREA FINDING THAT SAID PLAN <br />CONFORMS TO THE GENERAL PLAN FOR THE DEVELOPMENT OF THE <br />CITY; FINDING THAT THE FINANCING PLAN TO ENABLE THE AREA <br />TO BE REDEVELOPED IN ACCORDANCE WITH THE PLAN IS FEASIBLE <br />AND AFFORDS MAXIMUM OPPORTUNITY FOR DEVELOPMENT OF THE <br />AREA BY PRIVATE ENTERPRISE; FINDING THAT THERE IS NO NEED <br />FOR RELOCATION BECAUSE THERE ARE NO OCCUPANTS TO BE <br />DISPLACED FROM THE PROJECT AREA; PROVIDING FOR TAX ABATE- <br />MENT UNDER CHAPTER 353, REVISED STATUTES OF MISSOURI, AS <br />AMENDED; STATING NO OBJECTION TO THE ENTERING INTO BY THE <br />LAND CLEARANCE FOR REDEVELOPMENT AUTHORITY OF UNIVERSITY <br />CITY AND LEWIS CENTER REDEVELOPMENT CORPORATION OF A <br />REDEVELOPMENT CONTRACT; AND CONTAINING AN EMERGENCY <br />CAUSE. <br /> <br />WHEREAS, the City Council of the City of University City, by <br /> <br />Ordinance No. 5402, declared the real estate as described in Exhibit A <br /> <br />attached hereto and known as the Lewis Center Redevelopment Area (the "Project <br /> <br />Area"), to be blighted in the manner described in Chapter 9q and 353 of the <br /> <br />Revised Statutes of Missouri, 1978, as amended; and <br /> <br /> WHEREAS, this menace is beyond the remedy and control solely by <br />regulatory process in the exercise of the police power and cannot be dealt <br />with effectively by the ordinary operations of private enterprise without the <br />aids provided by the Land Clearance for Redevelopment Law, Sections qQ.030- <br />99.715, Revised Statutes of Missouri, 1978, as amended (the "Act"); and <br /> <br /> WHEREAS, the elimination or prevention of the detrimental conditions <br />in such areas, the acquisition and preparation of land in or necessary to the <br />development, the renewal or rehabilitation of such areas and its sale or lease <br />for development, renewal or rehabilitation in accordance with general plans <br />and redevelopment or urban renewal plans of the said City, and any assistance <br />which may be given by any public body of the said City in connection therewith <br />are public uses and purposes for which public money may be expended and <br /> <br />private property acquired; and <br /> <br /> WHEREAS, recommendations have been made to the University City <br />Council by the University City Plan Commission ("Plan Commission") and the <br />Land Clearance for Redevelopment Authority of the City of University City <br />("Authority") concerning a certain blighted, insanitary, deteriorated and <br /> <br />deteriorating area; and <br /> <br /> <br />
