property of equal value. Nor shall such valuation be increased <br />above fifty percent (50%) the true value of such real property <br />from year to year during said period of ten years so long as <br />said property is owned by an urban redevelopment corporation or <br />~ successor in interest or assignee of a redevelopment <br />corporation or any subsequent transferee of any thereof <br /> (whether voluntary or involuntary) and used for the purposes <br /> permitted in the Plan and this Agreement as from time to time <br /> amended. <br /> <br /> Notwithstanding the above, and so long as the owner of <br />the Project Area shall obtain the tax abatement Benefits <br />hereunder, the Redeveloper for itself and any successor or <br />assignee entitled to the benefit of such tax abatement <br />hereunder, shall make the in lieu of tax payments described in <br />Schedule ! attached hereto and hereby incorporated herein by <br />reference. <br /> The obligations to make the foregoing payments enume- <br />rated in this sectipn shall be enforceable directly by the City <br />of University City. <br /> <br /> In the event of the sale or other disposition of any <br /> such real property taxes as provided in this Section at any <br /> time and from time to time by reason of the foreclosure of any <br /> mortgage or other lien or through insolvency or bankruptcy <br /> proceeding or by order of any court of competent jurisdiction <br /> or by voluntary transfer or otherwise, it is the intention of <br /> the parties hereto that the partial tax relief provided for in <br />. ~Se~_tion 5 hereof be grante, d.~with respect to such property and <br /> <br /> shall inure to the benefit of any purchaser or other transferee <br /> thereof and to each and every purchaser or purchasers or other <br />~nsferee of any such real property so long as such real <br />~pr~e~rty is used for the uses permitted in the Plan and this <br />Agreement as now or hereafter from time to time amended. In no <br />'event shall the partial tax relief and abatement conferred <br />exceed twenty (20) years starting with the date of the first <br />year of such tax relief and with respect to the property, <br />regardless of ownership or transfer. <br /> <br /> For purposes of this Section 5, Lewis Center <br />Associates, a Missouri limited partnership, shall be deemed a <br />successor in interest to the Redeveloper whose acquisition of <br />the Project Area has been approved by the City Council of the <br />City of University City. As such an approved successor in <br />interest, Lewis Center Associates shall be entitled to the <br />benefits of tax abatement specified herein. <br /> <br /> Section 6. Signs. Signs upon the Project Area shall <br />conform to the requirements of the sign ordinances of the City <br />as amended to the extent such ordinances apply. <br /> <br />-4- <br /> <br /> <br />
