Section 7. Limitation on Governmental Assistance. <br />Redeveloper agrees and affirmatively covenants for and during <br />the term hereof that it will not accept nor apply for any <br />direct or indirect governmental funding or assistance, whether <br />local, County, state or federal, other than the assistance <br />obtained from the Authority, the City of University City or any <br />instrumentality thereof or benefits arising under the Internal <br />Revenue Code of 1954, as amended, and/or the Missouri Income <br />Tax Laws, in connection with the property or ~n connection with <br />the use, operation, maintenance, repair, or leasing of same <br />without first obtaining the prior written approval of the <br />Authority as to the specific funding or assistance to be <br />utilized by the Redeveloper. <br /> <br /> Section 8. Site Plans. The Redeveloper has submitted <br />to the Authority site plans (the "Site Plans") for the improve- <br />ments to be constructed on the Project Area. The Site Plans <br />may be modified by the Redeveloper after approval thereof in <br />writing by the Authority as design and construction progress so <br />long as the Site Plans as modified are in substantial confor- <br />mity with the provisions of the Plan, the Proposal, this <br />Agreement and applicable State and local laws and regulations. <br /> <br /> Section 9. Timing. Construction on the Project Area <br />will begin in September of 1983, and it is presently intended <br />that it will be completed prior to December 31, 1984, subject <br />to the following extensions: <br /> <br /> (a) Financing is not available to the Redeveloper in <br />such amounts and at such interest rate and upon such other <br />terms, provisions and conditions as are acceptable to the <br />Redeveloper; provided, however, that any extension of this <br />subparagraph shall not extend beyond December 31, 1984; <br /> <br /> (b) Failure of the City to grant site plan approval <br /> within thirty (30) days following submission of an application <br />(acceptable to the City for site plan approval; or <br /> <br /> (c) Any other cause beyond the reasonable control of <br />the Redeveloper as set forth in Section 11. <br /> <br /> Section 10. Certification of Completion of Improve- <br /> ments. Promptly after the Redeveloper has notified the <br />~Authority in writing of the date on which the construction of <br /> the improvements have been completed in accordance w-lth the <br /> Plan, the Site Plans, and this A~reement, the Authority shall <br /> certify that construction of the improvements has been so <br /> completed; provided the issuance of an occupancy permit, <br /> stating that the entire building has been completed, shall <br /> constitute conclusive evidence of the completion of the facility <br /> in accordance with the Plan and the Site Plans.
