<br />AN ORDINANCE AMENDING CHAPTER 28 OF THE MUNICIPAL CODE OF
<br />THE $ITY OF UNIVERSITY CITY, RELATING TO STREETS AND SIDE-
<br />WALKS, BY REPEALING SECTION 28-16 THEREOF, AS AMENDED BY
<br />ORDINANCE NO. 4246, ENACTED OCTOBER 17, 1966, RELATING TO
<br />PERMIT TO INSTALL WIRING, ETC, OVER STREETS, ETC., AND
<br />ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS
<br />"SECFION 28-16. NEW POLES AND ABOVE GROUND LINES ";
<br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY.

<br />BE IF ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY,
<br />
<br />MISSOURI, AS F')LLOWS:
<br />
<br />Section 1. Chapter 28 of the Municipal Code of the City of
<br />
<br />University Ci:y, relating to Streets and Sidewalks, is hereby amended by
<br />
<br />repealing Sec~ion 28-16 thereof, as amended by Ordinance No. 4246, enacted
<br />
<br />October 10, 1'~66, relating to permit to install wiring, etc. over streets,
<br />
<br />etc., and enacl~ing in lieu thereof a new section to be known as "Section 2~-
<br />
<br />16. New poles, and above ground lines," relating to the same subject, and re-
<br />
<br />enacting said section so that said section, as so amended, shall read as
<br />
<br />follows:
<br />
<br />Section 28-16. New poles and above ground lines.
<br />
<br />1. ].t shall be unlawful for any person to erect or
<br /> construct utility poles or lines for the trans-
<br /> rission of electricity, telephone messages, or other
<br /> ~ublic utility transmissions above the surface of
<br /> the ground within the confines of the City.
<br />
<br />2. ~othing contained in Section 1 shall prevent the
<br /> ~aintenance or repair of existing above ground
<br /> ~tility poles and lines, the erection, construction
<br /> ~nd maintenance of temporary poles and lines erected
<br /> Jn connection with construction projects in the
<br /> £ity.
<br />
<br />3. In case of any person duly authorized to do business
<br /> in the City, desiring to place along or across any
<br /> cf the streets, alleys, or public places of the
<br /> £ity, wires, tubular cables conveying electricity
<br /> for the production of light, heat or power, shall
<br /> file with the City Council the written consent of
<br /> any other telegraph or telephone company, or
<br /> electric light or power company, doing business in
<br /> the City to the placing of such wires, tubes, or
<br /> cables upon the poles of said telegraph, telephone,
<br /> electric light or power company situated in the
<br /> streets, alleys, or public places named in such
<br /> applications; the City Council in its discretion,
<br /> may grant a permit for such occupancy of the poles
<br /> of such other telegraph, telephone, electric light
<br /> or power company, with such restrictions, regu-
<br /> lations and qualifications as may be prescribed by
<br /> the City Council.
