Section 3. It is hereby <br /> <br />and all properties in the Project Area, <br />properties listed on Exhibit A to the <br />exercise of the power of eminent domain, <br /> <br />determined that the acquisition of any <br /> <br /> (excepting therefrom the <br /> Plan) is necessary by the <br /> that the granting of such <br /> <br />power <br /> <br />granted to University <br />public convenience <br />eminent domain or <br /> <br />is for the public convenience and necessity and there is hereby <br /> City Redevelopment Corporation a certificate of <br /> <br /> and necessity empowering it to acquire by <br /> otherwise all or any other part of the property <br /> <br />located in the Project Area (excepting therefrom the property listed on <br />Exhibit A to the Plan) for the purpose expressed in the plan in the <br />area included in the plan. <br /> <br /> Section 4. The City Manager is hereby authorized and directed to <br />execute on behalf of the City of University City a contract by and <br />between the City of University City and the University City <br />Redevelopment Corporation. <br /> <br /> Section 5. The said contract attached hereto and identified as <br />Exhibit C is hereby made a part of this ordinance. <br /> <br /> Section 6. The Sections of this ordinance shall be severable. In <br />the event that any section of this ordinance is found by a Court of <br />competent jurisdiction to be invalid or unconstitutional, the remaining <br />sections of this ordinance shall remain valid unless the court finds <br />the valid sections of this ordinance so essentially and inseparable <br />connected with, and so dependent upon, the void section that it cannot <br />be presumed that the City Council would have enacted the valid sections <br />without the void sections~ or unless the court finds that the valid <br /> <br />sections, standing alone, are incomplete and are incapable of being <br /> <br />executed in accordance with the legislative intent. <br /> <br /> Section 7. The passage of this ordinance being deemed necessary <br />for the immediate preservation of the health and safety of the public, <br />an emergency is hereby declared to exist and this ordinance shall take <br />effect immediately upon its approval by the Mayor. <br /> <br />-3- <br /> <br /> <br />
