Section 3. It is hereby and all properties in the Project Area, properties listed on Exhibit A to the exercise of the power of eminent domain, determined that the acquisition of any (excepting therefrom the Plan) is necessary by the that the granting of such power granted to University public convenience eminent domain or is for the public convenience and necessity and there is hereby City Redevelopment Corporation a certificate of and necessity empowering it to acquire by otherwise all or any other part of the property located in the Project Area (excepting therefrom the property listed on Exhibit A to the Plan) for the purpose expressed in the plan in the area included in the plan. Section 4. The City Manager is hereby authorized and directed to execute on behalf of the City of University City a contract by and between the City of University City and the University City Redevelopment Corporation. Section 5. The said contract attached hereto and identified as Exhibit C is hereby made a part of this ordinance. Section 6. The Sections of this ordinance shall be severable. In the event that any section of this ordinance is found by a Court of competent jurisdiction to be invalid or unconstitutional, the remaining sections of this ordinance shall remain valid unless the court finds the valid sections of this ordinance so essentially and inseparable connected with, and so dependent upon, the void section that it cannot be presumed that the City Council would have enacted the valid sections without the void sections~ or unless the court finds that the valid sections, standing alone, are incomplete and are incapable of being executed in accordance with the legislative intent. Section 7. The passage of this ordinance being deemed necessary for the immediate preservation of the health and safety of the public, an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its approval by the Mayor. -3-
