such persons, in connection with the sale or rental of a <br /> dwelling or in the furnishing of information, services, or <br /> facilities relative thereto, because of race, sex, color, <br /> religion, national origin, age, ancestry, handicap or <br /> marital status of any person. <br /> 2. The complaint procedure set forth in Sections S and 7 shall not be <br /> applicable to enforcement of the provisions of Section 6.1. Any <br /> persons who claim to have been injured under Section 6.1 shall <br /> file a written complaint directly with the City Council and City <br /> Attorney. <br /> Section 7. Commission on Human Rights. There is hereby created a Com- <br /> mission on Human Rights whose duty it will be to receive and investigate any and <br /> all written complaints charging discrimination, seek conciliation of such <br /> complaints, hold hearings, make findings fact and issue recommendations to the <br /> City Council and the City Attorney. The City Council shall review and make <br /> recommendations including the decision to prosecute or to instruct the City <br /> Attorney to file a civil suit to enjoin the violation or to take other appro- <br /> priate action. The Commission shall administer this Code in a manner e <br /> affirmatively to further the policies of . this Code and to prevent or eliminate <br /> discrimatory housing practices. The Commission shall cooperate with and render <br /> technical assistance to Federal, State, local and other public or private <br /> agencies, organizations and institutions which are formulating or carrying out <br /> programs to prevent or eliminate discriminating housing practices. <br /> Section 8. Appointments . The Commission on Human Rights shall consist of <br /> three (3) members who shall be appointed by the Mayor with the approval of the <br /> City Council. Each member shall serve for three (3) years, provided however, <br /> that the first appointment shall be for one, two and three years for each member <br /> respectively. The members shall be residents of the City of University City, <br /> registered voters in the said City and at least twenty-one (21) years of age. <br /> The Chairman shall be elected by the members of the Commission. <br /> Section 9. Complaint Process . Any person who claims to have been injured <br /> or who will be injured by a discriminatory housing practice may file a complaint <br /> with the Human Rights Commission. The complaint shall be filed within one <br /> hundred and eighty_ (180) days after the alleged discriminatory housing practice <br /> occurred. For purposes of this Section, all days of violation with respect to <br /> one dwelling shall be taken to mean one occurrence. Complaints shall be in <br /> writing and shall state the facts upon which the allegations of the discrimi- <br /> natory practice are based. Upon receipt of such complaint, a copy shall be <br /> furnished to the person or persons who allegedly committed or are about to <br /> commit the alleged discriminatory housing practice. <br /> Section 10. Penalty. Any person, firm or corporation violating any of the <br /> provisions of this Ordinance shall be punished by a fine not to exceed One <br /> Hundred Dollars ($100) or by imprisonment not to exceed ninety (90) days or by <br /> both fine and imprisonment. Each day a violation exists it shall be considered <br /> a separate offense. <br /> Section 11. Effective Date.
