INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> BILL NO. 7658 ORDINANCE NO. 5454 <br /> AN ORDINANCE FINDING THAT A CERTAIN BLIGHTED AREA EXISTS <br /> IN THE CITY OF UNIVERSITY CITY AND THAT THE REDEVELOP- <br /> MENT OF SUCH AREA IS NECESSARY AND IN THE PUBLIC INTEREST <br /> UNDER CHAPTER 99 , REVISED STATUTES OF MISSOURI, AS AMENDED; <br /> APPROVING THE REDEVELOPMENT PLAN ("PLAN") FOR THE <br /> TRINITY DELMAR REDEVELOPMENT AREA; FINDING THAT SAID <br /> PLAN CONFORMS TO THE GENERAL PLAN FOR THE DEVELOPMENT <br /> OF THE CITY; FINDING THAT THE FINANCING PLAN TO ENABLE <br /> THE AREA TO BE REDEVELOPED IN ACCORDANCE WITH THE <br /> PLAN IS FEASIBLE AND AFFORDS MAXIMUM OPPORTUNITY FOR <br /> DEVELOPMENT OF THE AREA BY PRIVATE ENTERPRISE; FINDING <br /> THAT THERE IS NO NEED FOR RELOCATION BECAUSE THERE ARE <br /> NO OCCUPANTS TO BE DISPLACED FROM THE PROJECT AREA; <br /> PROVIDING FOR TAX ABATEMENT UNDER CHAPTER 353 , REVISED <br /> STATUTES OF MISSOURI, AS AMENDED; AND CONTAINING AN <br /> EMERGENCY CLAUSE. <br /> WHEREAS, by reason of the predominance of defective or <br /> inadequate street layout, insanitary or unsafe conditions, <br /> deterioration of site improvements, improper subdivision or <br /> obsolete platting, and the existence of conditions which endanger <br /> life or property by fire and other causes, the area described in <br /> Exhibit A hereto (the "Project Area") retards the provision of <br /> housing accomodations or constitutes an economic or social <br /> liability or a menace to the public health, safety, morals or <br /> welfare in its present condition or use; and <br /> WHEREAS, the clearance, replanning, rehabilitation <br /> or reconstruction of the Project Area, and the provision for such <br /> industrial, commercial, residential, recreational, or public <br /> structures and spaces as may be appropriate, including other <br /> facilities incidental or appurtant thereto, is necessary and in <br /> the public interest under Chapter 99 of the Revised Statutes of <br /> Missouri, 1978 , as amended, and is necessary in the interest of <br /> public health, safety, morals and general welfare of the people <br /> of the City of University City; and <br /> WHEREAS, such conditions are beyond remedy and control <br /> solely by regulatory process in the exercise of the police power <br /> and cannot be dealt with effectively by ordinary private enterprise <br /> without the aids provided in the Urban Redevelopment Corporations <br /> Law, Chapter 353, Revised Statutes of Missouri, 1978 , as amended, <br /> and in the Land Clearance for Redevelopment Law, Chapter 99, <br /> Revised Statutes of Missouri, 1978, as amended. <br />
