least One Thousand Dollars, exclusive of fixtures and intoxicating <br /> liquors . Under such license no intoxicating liquor shall be con- <br /> sumed on the premises where sold nor shall any original package be <br /> opened on the premises of the vendor except as otherwise provided <br /> in this law. For every license for sale at retail in the original <br /> package, the licensee shall pay to the City One Hundred Fifty <br /> Dollars per year . <br /> b. For a permit authorizing the sale of malt liquor containing <br /> alcohol in. excess. of three.. and two-tenths per cent by weight and <br /> not in excess of five per cent by . weight by grocers and other <br /> merchants and dealers in the original package direct to consumers <br /> but not for resale, Twenty Two Dollars and Fifty Cents per year. <br /> The phrase "original package" shall be construed and held to refer <br /> to any package containing three or more standard bottles of beer. <br /> This license shall also permit the holders thereof to sell non- <br /> intoxicating beer in the original package direct to consumers, but <br /> not for resale. <br /> C. Malt liquor containing alcohol in excess of three and two- <br /> tenths per cent by weight and not in excess of five per cent by <br /> weight, manufactured from pure hops or pure extract of hops or pure <br /> barley malt or wholesome grains or cereals and wholesome yeast and <br /> pure water may be sold by the.drink at retail for consumption on <br /> the premises where sold. . . For. every .license issued for sale of malt <br /> liquor, at retail by the drink . for. consumption on the premises <br /> where sold, the licensee shall.p ay to .the City the sum of Fifty Two <br /> Dollars and Fifty Cents per year.,. which license shall also permit <br /> the holder thereof to sell non-intoxicating beer as defined in this <br /> Code. <br /> d. For every license issued for the sale of all kinds of intoxi- <br /> cating liquor, at retail by the drink for consumption on premises <br /> of licensee, the licensee shall pay to the Director of Finance the <br /> sum of Four Hundred Fifty Dollars .per year, which shall include the <br /> sale of intoxicating liquor in the. original package, provided, how- <br /> ever, no license shall .,hereafter be issued except to the owner, <br /> proprietor, .manager or keeper of a bona fide restaurant or hotel <br /> dining room where food is regularly or customarily sold at tables <br /> for consumption on premises., at retail, in the ordinary and usual <br /> course of the restaurant business; and no such license shall be <br /> issued unless said licensee shall conduct fifty per cent or more of <br /> his sales volume in food on said premises or which has an annual <br /> gross income of at least Two Hundred Seventy-five Thousand Dollars <br /> from the sale of prepared _ meals. or food. consumed on the premises. <br /> For the initial license year the licensee shall estimate his sales <br /> volume and for each year thereafter the sales volume shall be <br /> determined by the previous six months sales, or that part of the <br /> license term during which he holds his license. The provision of <br /> this paragraph as to the sale of food on the licensed premises <br /> shall not apply to any location licensed hereunder on the effective <br /> date of this ordinance or to any transferee at said location; pro- <br /> vided, however, said location has operated under a license within <br /> twelve months prior to the applicant filing for a license under <br /> this section. <br /> e. For every license issued for the sale of malt liquor containing <br /> alcohol in excess of three and .two-tenths per cent by weight and <br /> not in excess of five per cent. _:.by weight,. manufactured from pure <br /> hops or pure extract of hops or pure barley malt or wholesome <br /> grains or cereals and wholesome yeast and pure water, or light <br /> wines containing not in excess of fourteen per cent of alcohol by <br /> weight exclusively from grapes, berries and other fruits and vege- <br /> tables, or both such malt liquor and wine,. .at retail by the drink <br /> for consumption on premises of licensee, the licensee shall pay to <br /> the Director of Finance the sum of Fifty Two Dollars and Fifty Cents <br /> 3 <br />
