INTRODUCED BY COUNCILMEMBER MAJERUS <br /> BILL NO. 7700 ORDINANCE NO. 5496 <br /> AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br /> THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING <br /> SECTION 34-90 RELATING TO DEFINITIONS, AND ENACTING THEREIN <br /> A NEW SECTION TO BE KNOWN AS "SECTION 34-90 DEFINITIONS" BY <br /> AMENDING SAID SECTION SO AS TO CHANGE THE DEFINITION OF <br /> "DWELLING UNIT . AND TO CHANGE THE DEFINITIONS OF "ATTACHED <br /> SINGLE-FAMILY DWELLING," "DETACHED SINGLE-FAMILY DWELLING," <br /> "FAMILY," AND "TWO-FAMILY DWELLING" TO INCLUDE THE TERM <br /> "DWELLING UNIT"; CONTAINING A SAVING CLAUSE AND PROVIDING A <br /> PENALTY. <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of University <br /> City (University City Zoning Code) divides the City into several zoning <br /> f <br /> districts, and regulates the uses to which the premises located therein may be <br /> put; and <br /> WHEREAS, Section 34-90 thereof provides for Definitions; and <br /> WHEREAS, the City Plan Commission, after a hearing, reviewed said <br /> section; and <br /> WHEREAS, due notice of a public hearing to be held by the City Council <br /> in the Council Chamber at City Hall, at 7:30 P.M. on the 19th day of August, <br /> 1985, was duly published; and <br /> } <br /> WHEREAS, said public hearing was duly held at the time and place speci- <br /> fied in said notice, and all suggestions_.or objections concerning said change in <br /> said section were duly heard and considered by the Council. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br /> CITY, MISSOURI, AS FOLLOWS: F <br /> Section 1. Chapter 34 of the Municipal Code of the City of University <br /> City, Missouri, as comprehensively amended June 11, 1979, by Ordinance No. 5173, F <br /> is hereby amended by repealing Section 34-90 thereof, relating to definitions, <br /> and enacting in lieu thereof a new section by . amending Section 34-90, <br /> Definitions, so as to change the definition of "Dwelling Unit," and to change <br /> the definitions of "Attached Single-family Dwelling," "Detached Single-family <br /> Dwelling," "Family," and "Two-family Dwelling" to include the term "Dwelling <br /> Unit" so that said section as so amended shall read as follows: <br /> ARTICLE VII - DEFINITIONS <br /> Section 34-90 <br /> Accessory use (Structure) - See Section 34-52.2. <br /> Alley - cf. Public Service Drive. <br /> Apartment Dwelling - A building or portion thereof, designed <br /> for occupancy by three (3) or more families living indepen- <br /> dently of each other, exclusive of attached single-family <br /> dwellings, townhouses, or patio houses or individually <br /> subdivided lots. <br />
