INTRODUCED BY COUNCILMEMBER LEVY BILL NO. 7712 ORDINANCE N0. 5508 AN ORDINANCE APPROVING THE DEVELOPMENT PLAN SUBMITTED BY THE TRINITY/DELMAR REDEVELOPMENT CORPORATION HEREINAFTER REFERRED TO AS THE "DEVELOPER", CONFIRMING THE AREA AS A BLIGHTED AREA WHICH SHOULD BE REDEVELOPED IN THE PUBLIC INTEREST; FINDING THAT SUCH DEVELOPMENT PLAN CONFORMS TO THE COMPREHENSIVE PLAN OF THE CITY; AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT ON BEHALF OF THE CITY WITH THE DEVELOPER SETTING FORTH THE TERMS AND CONDITIONS OF SAID CONTRACT; INCORPORATING BY REFERENCE CHAPTER 353, R.S. MO. 1978, AS AMENDED; CONTAINING AN EMERGENCY CLAUSE. WHEREAS, Developer did on May 15, 1985, duly submit a proposed plan of development (the "Development Plan") for the real estate described below (and known as the "Trinity Delmar Redevelopment Area") to the City Plan Commission. The area consists of a tract of land in the City of University City containing approximately 21,300 square feet and being more specifically described as follows: Lot 8 and part of Lot 7 in Block 2 of UNIVERSITY HEIGHTS Amended Subdivision No. 2, according to the plat thereof recorded in Plat Book 7 , page 69, of the St. Louis County Records, with all improvements thereon, also known and numbered 6900 Delmar Boulevard, University City, Missouri. In addition, Developer has entered into an easement for an estimated 40 feet at the south side of said tract of land, with the University Methodist Church, for expanded parking; and WHEREAS, thereafter the City Plan Commission did make an independent study and investigation of the Development Plan, and thereafter on May 22, 1985, did adopt a resolution approving the Development Plan, which resolution was duly transmitted to the Mayor and the City Council on May 31, 1985; and WHEREAS, the City Plan Commission determined that the Development Plan is in the public interest and serves a public purpose; and WHEREAS, by Ordinance Numbers 5352, 5419 and 5455, the City Council declared said area to be blighted in the manner described in Chapter 353 of the Revised Statutes of Missouri, 1978, as amended. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. It is hereby declared that the Development Plan, attached hereto and incorporated herein as Exhibit A, as submittedf May 15, 1985, and as subsequently approved by the City Plan Commission and thereafter transmitted and recommended to the City Council for the following herein above described area, is
