any mortgage or other lien, through insolvency or bankruptcy proceedings, <br /> by order of any Court of competent jurisdiction, by voluntary transfer or <br /> otherwise and the purchaser of such real property shall continue to use, <br /> i <br /> operate and maintain such real property in accordance with the uses of the <br /> Amended Plan, said property shall continue to receive the partial tax relief <br /> provided in Chapter 353.110 R.S.Mo. , 1978, as amended, for the remainder of <br /> the tax abatement period upon approval by the City Council. If such real <br /> property shall be used for a use different from that described in the <br /> Amended Plan, or in the event the purchaser does not desire the property to <br /> continue under the Amended Plan, the real property shall be assessed for ad <br /> valorem taxes upon the true value of the real property and improvements at <br /> that point in time. <br /> B. The terms conditions and <br /> provisions of this Agreement and other <br /> development plan shall not be substantially modified or limited except by <br /> mutual agreement between the City, the Authority and UCRC, its successors <br /> and assigns; provided, however, that this agreement shall not be construed <br /> as an enlargement of the authority conferred upon the City by Chapter 353 of <br /> the Revised Statutes of Missouri, 1978, as amended. <br /> This agreement shall remain in full force and effect so long as UCRC, <br /> its successors or assigns, shall enjoy tax relief <br /> g pursuant to Chapter 353 <br /> i <br /> R.S.Mo. , and Ordinance No. 5085 of the City of University City, as modified <br /> by Ordinance No. 5165. <br /> f <br /> —6— <br />
