Seca_ 12A-3.._....Basis _for establishing areas of special flood <br /> hazard: <br /> The areas of special flood hazard identified by the <br /> Federal Insurance_ Administration through a scientific and <br /> engineering_report. entitled -'The Flood Insurance Study for <br /> _the. City of University City` dated December 1977, with <br /> accompanying Flood_.Insurance Rate- Maps and Flood Boundary <br /> and Floodway Maps...a.nd. . any. revision thereto are hereby <br /> adopted. by reference. and declared to be a part of this <br /> chapter. <br /> Sec. Establishment of development permit. <br /> A development_pe.rmit shall -be required in conformance with <br /> the provisions of this chapter, <br /> Sec. 12A-5. Compliance : <br /> -_ ..No development. shall. take- place- without full compliance <br /> . with the terms of this _chap.ter and other applicable <br /> regulations. <br /> ..Sec. 12A-6.. Abrogation and greater restrictions. <br /> This chapter is not intended_to repeal, abrogate, or <br /> . impair. an-y existing easements., covenants, or deed restric- <br /> tions; however, where this chapter and another conflict or <br /> overlap, whichever imposes the more stringent restrictions <br /> shall prevail. <br /> Sec. 12A-7, Interpretation <br /> In the interpretation and application of this chapter all <br /> provisions shall be: <br /> (1) Considered as minimum requirements; <br /> (2.) Liberally construed__in favor of the governing body; <br /> and <br /> (3) Deemed neither to limit.nor repeal any other powers <br /> granted under State Statutes. <br /> Sec.. 12A 7-8. Wa.rning_,.and. disclaimer of liability. <br /> The .degr.ee_of-4lood-.Ora tection required by this chapter is <br /> considexed_reasnz�ahle_.fvr regulatory purposes and is based <br /> on __scientific and ....engineer.ing_-._considerations. Larger <br /> floods can and. .-will- occur- ' on _ rare occasions, Flood <br /> .heights may_ be._increased. :_by.manmade or natural causes. <br /> .This._chapte.r does.:not.-imply that land outside the areas of <br /> special .flood_hazards_.or uses permitted within such areas <br /> will be free from. flooding._.or'.. flaod damages, This chapter <br /> shall .not. create._liability on the part of the City or by <br /> any officer or employee_thereof_ for any flood damages that <br /> result .from reliance. on. this_chapter or any administrative <br /> decision lawfully made. thereunder. <br /> _.S.ec._ 12A-9. ._ Designation of local administrator. <br /> The Director of_ Public__Wo.rks. .is_hereby appointed to admin- <br /> is.ter._._.and._ implement_ the . provisions of this chapter. <br /> Duties and responsibil ties.:of. the local administrator <br /> shall.include, but not be limited to: <br /> (1) Review all development_.permits to assure that sites <br /> are reasonably safe. fr.om: flooding and that the permit <br /> . requirements of this chapter have been satisfied; <br /> (2) Review permits for proposed development to assure <br /> that all -necessary permits have been obtained from those <br /> federal.,- .state or local governmental agencies from which <br /> prior approval is required; <br /> (3) Notify adjacent communities and Missouri Disaster <br /> Planning and Operations. Office prior to any alteration or <br /> relocation of a water course, and shall submit evidence of <br /> such notification -to the Federal Insurance Administration; <br /> 4 <br />
