Introduced by Councilmember Schoomer <br /> <br />BILL NO. <br /> <br /> 7831 ORDINANCE NO. 5627 <br /> <br />AN ORDINANCE AMENDING CHAPTER 6 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY RELATING TO BUILDINGS BY <br />REPEALING ARTICLE I THEREOF, AS AMENDED BY ORDINANCE NO. <br />5541, ENACTED 3UNE 16, 1986, RELATING TO THE BUILDING CODE <br />AND ENACTING IN LIEU THEREOF A NEW ARTICLE TO BE KNOWN AS <br />"ARTICLE I BUILDING CODE" SO AS TO ADOPT THE BOCA NATIONAL <br />BUILDING CODE, TENTH EDITION, 1987; CONTAINING A SAVING <br />CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, subsequent to the approval on June 16, 1986, of Ordinance <br />No. 5541, adopting the "BOCA Basic National Building Code, Ninth Edition, <br />1984" as published by the Building Officials and Code Administrators Inter- <br />national, Inc,, a new edition known as the BOCA National Building Code, Tenth <br />Edition, 1987, has been published by said Building Officials and Code Adminis- <br />trators International, Inc., and <br /> <br /> WHEREAS, it is d~sired to adopt, by reference, "The BOCA National <br />Building Code, Tenth Edition, 1987" as published by the Building Officials and <br />Code Administrators International, Inc., with certain modifications herein- <br />after set forth, <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 6 of the Municipal Code of the City of Univer- <br />sity City relating to Buildings is hereby amended by repealing Article I <br />thereof, as amended by Ordinance No. 5541, enacted June 16, 1986 relating to <br />the Building Code and enacting in lieu thereof a new article to be known as <br />"Article I Building Code" so as to adopt the BOCA National Building Code, <br />Tenth Edition, 1987, relating to the same subject, and re-enacting said <br />article so that said article as so amended, shall read as follows: <br /> <br />ARTICLE I BUILDING CODE <br /> <br />Section 6-1 Adoption: The BOCA-National Building Code, Tenth Edition, 1987, <br />as published by the Building Officials and Code Administrators International, <br />Inn., three copies of which are on file in the office of the City Clerk and a <br />copy of which is attached hereto, be and is adopted as the Building Code of <br />the City of University City, Missouri, for the control of buildings and struc- <br />tures as herein provided; and each and all of the regulations, provisions, <br />penalties, conditions, and terms of the BOCA National Building Code, Tenth <br />Edition, 1987 are hereby referred to, adopted and made a part hereof, as if <br />fully set out in this ordinance, with the additions, insertions, deletions and <br />changes prescribed in Section 6-1.1 of this Article. <br /> <br />Section 6-1.1 Additions, Insertions, Deletions and Changes: The following <br />numbered subsections of the BOCA Basic National Building Code, Tenth Edition, <br />1987, are amended by additions, insertions, deletions and changes, including <br />the changing of subsection titles and the addition of new subsections so that <br />such amended and added subsections read as follows: <br /> <br />ADMINISTRATION AND ENFORCEMENT <br /> <br />SECTION 100.0 SCOPE <br /> <br />100.1 Title: These regulations shall be known as the Building Code of the <br />City of University City, Missouri, hereinafter referred to as "this code", <br />The terms: "name of jurisdiction" or "local jurisdiction" wherever employed <br />herein shall mean the City of University City, Missouri. <br /> <br />101.3 Determination of Essential Requirements: Any requirement relative to <br />the manner of construction or material to be used in the erection, addition, <br />alteration, repair, removal, demolition, installation of service equipment and <br />the location, use, occupancy or maintenance of all structures, which is <br />essential to insure public safety, health or welfare, and which is not speci- <br />fically covered by the provisions of this code, shall be as determined by the <br />code official, on the basis of the legislative intent of this code as set <br />forth in Section 100.0 and the provisions of this code for similar or related <br />matters. <br /> <br /> <br />
