Rezoning for #1 McKnight Place <br />Ms. Brot apologized to all the citizens in attendance who had come, saying she <br />had not known about the continuation until shortly before the start of this meeting. <br />Ms. Brot encouraged anyone there to speak if they could not be present at the <br />next Council meeting. <br /> <br />2. Comprehensive Plan Update <br /> <br />Both hearings relating to the expansion and rezoning of #1 McKnight Place were <br />continued to the next Council session on February 26, 2007, due to the request of <br />the developer Mr. Charlie Deutsch. <br /> <br />The Public Hearings were opened at 6:45 p.m. <br /> <br />CITIZEN COMMENTS <br />1. Tom Malon, 8677 Barby Lane <br />Mr. Malon stated that he had e-mailed a message to all Councilmembers <br />stating that Barby Lane was originally dedicated for public use and should not <br />be closed by the City. He quoted from the survey drawing “The undersigned <br />owner of the tract of land hereon platted and further described in the <br />accompanying Surveyor’s Certificate, has caused the same to be surveyed and <br />subdivided in the manner as shown on this plat which subdivision shall <br />hereafter be known as ‘Barby Lane.’ The portions of Barby Lane, 50 feet wide, <br />and the Cul-de-Sac, at the west end, which for better identification are shown <br />hatched on the above plat are hereby dedicated to the public use forever. The <br />easements shown on the above plat are hereby dedicated to the City of <br />University City, Missouri, for the purposes of installing and maintaining public <br />utilities and sewers, in, under, or over said strips. The building lines as shown <br />are hereby established.” Mr. Malon did not believe University City had the <br />authority to close part of Barby Lane to be used for private use since this <br />subdivision street was dedicated for public use forever. <br /> <br />Mark Frank, 8686 W. Kingsbury Ave <br />Mr. Frank questioned the City’s opinion of the rezoning and why the City’s <br />version was different from Mr. Deutsch’s original request. <br /> <br />Mr. Lehman Walker, Director of Community Development for University City <br />stated that the staff recommended no change in the Single Family zoning on a <br />couple of lots as an assurance to maintain its current single-family residential <br />nature. In the future, if Mr. Deutsch wanted to expand to these remaining <br />single-family zoned properties, he would have to submit another proposal to <br />the Planning staff. <br /> <br />The Public Hearing was adjourned at 7:05 p.m., to the next Public Hearing on <br />February 26, 2007, at 6:30 p.m. <br /> <br /> <br /> <br /> 3 <br /> <br />
