(SECTION 121.0 EMERGENCY MEASURES) <br />121.1 Vacating structures: When, in the opinion of the code <br />official, there is actual and immediate danger of failure or <br />collapse of a structure or part thereof which would endanger life, <br />or when any structure or part of a structure has fallen and life is <br />endangered by the occupation of the building or structure, or when <br />there is actual or potential danger to the building occupants or <br />those in the proximity of any building because of explosives, <br />explosives fumes or vapors or the presence of toxic fumes, gases or <br />materials, or use of defective or dangerous equipment, the code <br />official is hereby authorized and empowered to order and require <br />the occupants to vacate the same forthwith. He shall cause to be <br />posted at the main entrance to such structure, a notice reading as <br />follows: "THIS STRUCTURE IS UNSAFE AND ITS USE OR OCCUPANCY HAS <br />BEEN PROHIBITED BY THE CODE OFFICIAL." It shall be unlawful for <br />any person to enter such structure except for the purpose of making <br />the required repairs or of demolishing the same. <br /> <br />121.2 Temporaz7 safeguards: Notwithstanding other provisions of <br />this code, whenever in the opinion of the code official, there is <br />actual and immediate danger of collapse or failure of a structure <br />or any part thereof which would endanger life, or there is an <br />actual and immediate danger because a vacant or partially vacant <br />building is unguarded or has any open doors or windows, thereby <br />creating a fire hazard or other security hazard or endangering life <br />or property, the code official shall cause the necessary work to be <br />done including the boarding-up of all accessible openings, to <br />render such building or structure or part thereof temporarily safe. <br /> <br /> (SECTION 123.0 BOARD OF SURVEY) <br />123.3 Compensation and fees: The third member shall receive as <br />compensation for services a fee of four hundred dollars to be paid <br />to the City by the appellant at the time of filing the application. <br />The application must also be accompanied by an application fee in <br />the amount specified by local ordinances. <br /> <br /> (SECTION 124.0 MEANS OF APPEAL) <br />124.1 Application for appeal: Any interested person shall have <br />the right to appeal to the Board of Appeals from a decision of the <br />code official refusing to grant a modification to the provisions of <br />this code covering the manner of construction or materials to be <br />used in the erection, alteration or repair of a building or <br />structure. An application for appeal shall be based on a claim <br />that the true intent of this code or the rules legally adopted <br />thereunder have been incorrectly interpreted, the provisions of <br />this code do not fully apply, or an equivalent form of construction <br />can be used. <br /> <br />124.1.1 Filing procedure: All appeals shall be filed in writing <br />with the code official within thirty (30) days after the decision <br />to be appealed is rendered by the code official. Appeals must be <br />accompanied by a fee in the amount specified in local ordinances. <br /> <br />124.2 Membership of board: The Board of Appeals shall consist of <br />seven members appointed by the City Council. Board members shall <br />be appointed for a five year term and serve until a successor has <br />been appointed. 8 <br /> <br /> <br />
