A structure or part thereof which because of the degree of <br />disrepair or lack of maintenance is so unsanitary, vermin or <br />rat infested, filthy or contaminated, or lacking in <br />ventilation, sanitary facilities, heating facilities or other <br />code required equipment that is hazardous to the health or <br />safety of the occupants or members of the public. <br /> <br />PM-114.3 Mandatory demolition or repair of a public nuisance <br />The following steps shall be taken to effect the mandatory <br />demolition or repair of a structure which is deemed to be <br />detrimental to the health, safety or welfare of the residents of <br />the City of University City and which is declared a public <br />nuisance. <br /> <br />PM-114.3.1 Notice of declaration of nuisance <br />A notice of declaration of nuisance and pre-hearing order shall be <br />prepared in substantially the following form: <br /> <br />NOTICE OF DECLARATION OF NUISANCE <br />AND PRE-HEARING ORDER <br /> <br />THE STRUCTURE OR STRUCTURES DESCRIBED BELOW RAVE BEEN DECLARED A <br />NUISANCE. <br /> (Insert address or other adequate description <br /> of the building or structure.) <br /> <br />(Use one or two of the following three paragraphs.) <br /> <br />NO PERSON MAY OCCUPY THIS BUILDING, OR ANY PART THEREOF, AFTER <br /> , 19 After such date, no person shall occupy, <br />enter, refuse to leave, or remain in this building or any part <br />thereof, except persons directly employed in securing, repairing or <br />removing such building. <br /> <br />THIS STRUCTURE MUST BE REPAIRED TO CURE THE FOLLOWING DEFECTS: <br /> <br />WORK MUST BEGIN ON OR BEFORE , 19 , AND PROCEED <br />CONTINUOUSLY WITHOUT UNNECESSARY DELAY TO COMPLETION. This order <br />may be obeyed by demolition and removal of this structure. Upon <br />failure to repair as herein required, the code official may, after <br />hearing, order repairs to be made and the cost charged to the owner <br />of this property as a special tax lien. <br /> <br />THIS STRUCTURE MUST BE DEMOLISHED AND REMOVED FROM THE PREMISES NO <br />LATER THAN , 19 If demolition is not begun and <br />carried forth promptly, the code official may, after a hearing, <br />order the same demolished and the cost assessed against the <br />property as a special tax lien. Upon presentation of adequate <br />plans, the code official may allow repair instead of demolition. <br /> -7- <br /> <br /> <br />
