BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER SCHOOMER <br />8108 ORDINANCE NO. <br /> <br />5896 <br /> <br />AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY RELATING TO <br />NUISANCES, AND ENACTING THEREIN A NEW SECTION TO BE <br />KNOWN AS "SECTION 22-25. PLACES USED FOR ILLEGAL_ <br />SALE AND USE OF CONTROLLED SUBSTANCES," SO AS TO <br />COMPLY WITH THE STATUTES OF THE STATE OF MISSOURI, <br />AND PROVIDING A PENALTY <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section !. Chapter 22 of the Municipal Code of the City <br />of University City, relating to nuisances is hereby amended <br />by enacting a new section Lo be known as "Section 22-25. <br />Places Used for Illegal Sale and lJse ,~f Controlled <br />Substances" reading as follows: <br /> <br />22-25 PLACES USED FOR ILLEGAL SALE AND USE OF <br /> CONTROLLED SUBSTANCES <br /> <br />Any room, building, structure or inhabitable <br />structure which is used for the illegal use~ <br />keeping or selling of controlled substances <br />a public nuisance. No person shall keep or <br />maintain such a public nuisance. <br /> <br />In addition to any other municipal ordinance <br />prosecutions, the city prosecutor may by <br />information charge the owner or ~he occupant, <br />or both the owner and the occupant of Lhe <br />room, building, structure, or inhabitable <br />structure with the violation of keeping <br />maintaining a public nuisance. <br /> <br />Notwithstanding the other sections of this <br />chapter, if the City Manager or his design{ee <br />finds that tlne owner of the room, building, <br />structure or inhabitable structure knew th~ <br />the premises were being used for the illegal <br />use, keeping, or selling of controlled sub-- <br />stances, the City Manager or his designee may <br />order that the premises shall not be occupied <br />or used for such period as the City Manager or <br />his designee may determine, not to exceed one <br />year. <br /> <br />It is unlawful for any person to occupy or use <br />or to permit the occupancy or use of any room, <br />building, structure, or inhabitable structure <br />in violation of an order issued by the City <br />Manager or his designee pursuant to thms <br />section. <br /> <br /> <br />
