appropriate agency (such approval not to be unreasonably withheld <br />or delayed) . The plans and specifications prepared by The Lawrence <br />Group, Inc. dated , 1993 for the London Parking Lot are <br />hereby approved by the parties, and such approval shall be <br />evidenced on such plans and specifications by initialling or other <br />appropriate identification thereof bytheparties. As so approved, <br />said plans and specifications are incorporated herein by this <br />reference and are hereinafter referred to as the "Approved Plans.. <br />In the event such maintenance and repair is not carried out to the <br />City's satisfaction, the City my, after fifteen (15) business days <br />written notice to London, perform such maintenance and repair and <br />London shall reimburse the City for the costs thereof within thirty <br />(30) days thereafter. <br /> <br /> 6. Maintenance and Re~air of the CMon Lot. During the <br />term of theLondon Parking LotEasementand the Cuu~on Lot License, <br />the City shallbe responsible for the maintemsmceand repair of the <br />Cor~non Lot, at its expense. Maintenance and repair shall include <br />resurfacing, as necessary, and snow and debris removal, as <br />necessary, for the use of the Common Lot as a parking lot. In <br />addition, within ninety (90) days of the initiation of this-Parking <br />Easement and License Agreement the City shall construct at its cost <br />the new access improvements and the additional parking in the <br />Comon Lot described in the Approved Plans. <br /> <br /> 7. Duration of Easement and License. The term of each of <br />the London Parking Lot Easement and the License which are contained <br />in this Agreement II shall be for a period which when added to the <br />actual expired term of the Parking Easement and LicenseAgreement I <br />recorded at Book Page __ of the Recorder of Deeds Office <br />of St. Louis County equals a total of twenty (20) years co~nencing <br />upon the date upon which an occuPancY permit is issued to Londonby <br />the City permitting occupancy of the London Property. <br /> <br /> 8. Extent of Rights. The City reserves all rights in the <br />Loop Parking Lot not expressly surrendered or affected hereby and <br />reserves the right to take any action as may be necessary or <br />appropriate to prevent a dedication to the public of the Loop <br />Parking Lot. The Easement and License shall runwlth the land for <br />the benefit of the London Property for the duration of the Easement <br />and License set forth herein. <br /> <br /> 9. Bindin~ Mf~ect. This Agreement shall be binding on and <br />inure to the benefit of the parties hereto and their respective <br />successors in interest in the Loop Parking Lot and in the London <br />Property, respectively. Any successor in interest in the entirety, <br />or any portion of, the Loop Parking Lot, or in the entirety, orany <br />portion, of the London Property, shall take the same subject to the <br />benefits and burdens hereof and hereunder.
