BILL <br /> <br />NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER SCHUMAN <br />8147 ORDINANCE NO. <br /> <br />5934 <br /> <br />AN ORDINANCE AMENDING CHAPTER 54 OF THE MUNICIPAL CODE <br />OF THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY <br />REPEALING SECTION 54-34.4, AS AMENDED BY ORDINANCE NO. <br />5826 PASSED SEPTEMBER 16, 1991, RELATING TO "PR-O" <br />PLANNED RESIDENTIAL-OFFICE DISTRICT, AND ENACTING IN <br />LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION <br />34-54.4. CONDITIONAL USES," BY ADDING THE CLASSIFICA- <br />TION OF "ACCESS ROAD"; CONTAINING A SAVING CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of <br />University City (University City Zoning Code) divides the City <br />several zoning districts, and regulates the uses to which the <br />premies located therein may be put; and <br /> <br />into <br /> <br /> WHEREAS, Section 34-34.4 provides for "conditional uses" under <br />the same type of district; and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at the <br />City Hall on August 25, 1995, at 7:30 p.m. recommended an amendment <br />of Section 54-54 of the University City Zoning Code by adding <br />"access road" to Section 54-54.4; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City <br />Council in the City Council Chambers at City Hall at 7:50 p.m. <br />October 4, 1995, was duly published in the Watchman-Advocate, a <br />newspaper of general circulation within said City on September 17, <br />1995; and <br /> <br /> WHEREAS, said public hearing was held at the time and place <br />specified in said notice, and all suggestions or objections <br />concerning said amendment were duly heard and considered by the <br />council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 54 of the Municipal Code of the City of <br />University City, Missouri, relating to zoning is hereby amended by <br />repealing Section 54-54.4 thereof, relating to "Conditional Uses" <br />and enacting in lieu thereof a new section to be known as "Section <br />54-54.4, Conditional Uses" by adding "access road," relating to the <br />same subject, and re-enacting said section so that said section, as <br />so amended, shall read as follows: <br /> <br />-1- <br /> <br /> <br />
