INTRODUCED BY COUNCILMEMBER SCHUMAN <br />BILL NO. 8149 ORDINANCE NO. 5936 <br /> <br />AN ORDINANCE AMENDING CHAPTER 54 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY RELATING TO <br />ZONING BY REPEALING "SECTION 34-40.5, AS AMENDED BY <br />ORDINANCE NO. 5785 PASSED DECEMBER 10, 1990, RELAT- <br />ING TO "PA" PUBLIC ACTIVITY DISTRICT, AND ENACTING <br />IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 34-40.3. CONDITIONAL USES," BY ADDING THE <br />CLASSIFICATION OF "ACCESS ROAD"; CONTAINING A <br />SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 54 of the Municipal Code of the City of <br />University City (University City Zoning Code) divides the <br />City into several zoning districts, and regulates the uses to <br />which the premises located therein may be put; and <br /> <br /> WHEREAS, Section 54-40.5 provides for "conditional uses" <br />under the same type of district; and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at <br />the City Hall on August 25, 1993, at 7:50 p.m. recommended an <br />amendment of Section 34-40 of the University City Zoning Code <br />by adding "access road" to Section 34-40.5; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by <br />the City Council in the City Council Chambers at City Hall at <br />7:30 p.m. October 4, 1995, was duly published in the <br />Watchman-Advocate; a newspaper of general circulation within <br />the City on September 17, 1995; and <br /> <br /> WHEREAS, said public hearing was duly held at the time <br />and place specified in said notice, and all suggestions or <br />objections concerning such change in said section were duly <br />heard and considered by the Council. <br /> <br /> NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 54 of the Municipal Code of the City <br />of University City, Missouri, relating to zoning is hereby <br />amended by repealing Section 54-40.3 thefor, relating to <br />"Conditional Uses" and enacting in lieu thereof a new section <br />to be known as "Section 54-40.5, Conditional Uses" by adding <br />"access road," relating to the same subject, and re-enacting <br />said section so that said secion, as so amended, shall read <br />as follows: <br /> <br />34-40.3 Conditional Uses <br /> <br />1.
