BILL NO. INTRODUCED BY COUNCILMEMBER COTTON 8202 ORDINANCE NO. 5987 AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING SECTION 34-4~.3, RELATING TO "'PA' PUBLIC ACTIVITY DISTRICT", AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWNAS "SECTION 34-40.3. CONDITIONAL USES," BY ADDING THE CLASSIFICATION OF "OUTDOOR BUS PARKING FACILITY"; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. WHEREAS, Chapter 34 of the Municipal Code of the City of University City (University City Zoning Code) divides the City into several zoning districts, and regulates the uses to which the premises located therein may be put; and WHEREAS, Section 34-4e.3 provides for "conditional uses" under the same type of district; and WHEREAS, the City Plan Commission in a meeting held at the City Hall on October 31, 1994, at 7:30 p.m. recommended an amendment of Section 34-40.3 of the University City Zoning Code by adding "outdoor bus parking facility" to Section 34-4~.3; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chambers at City Hall at 7:30 p.m., November 7, 1994, was duly published in the Watchman-Advocate, a newspaper of general circulation within said City on October 20, 1994; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said amendment were duly heard and considered by the council; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CiTY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS= Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, relating to zoning is hereby amended by repealing Section 34-40.3 thereof, relating to "Conditional Uses", and enacting in lieu thereof a new section to be known as "Section 34-40.3, Conditional Uses", relating to the same subject, and re-enacting said section so that said section, as so amended, shall read as follows: Business, professional, medical or institutional offices. Hospitals, residential and outpatient substance abuse treatment centers, and other institutions of a religious, educational charitable or philanthropic nature, provided that such buildings shall not be Located upon sites containing less than three (8) Public utilities and services, including sub-stations, special rights of way and easements, provided that the exterior appearance of any building so permitted shall be in keeping with the character of the neighborhood in which it is located. d.
