BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER COTTON <br /> <br />8202 ORDINANCE NO. 5987 <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING SECTION 34-4~.3, <br />RELATING TO "'PA' PUBLIC ACTIVITY DISTRICT", AND ENACTING IN LIEU <br />THEREOF A NEW SECTION TO BE KNOWNAS "SECTION 34-40.3. CONDITIONAL <br />USES," BY ADDING THE CLASSIFICATION OF "OUTDOOR BUS PARKING <br />FACILITY"; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of University City <br />(University City Zoning Code) divides the City into several zoning districts, and <br />regulates the uses to which the premises located therein may be put; and <br /> <br /> WHEREAS, Section 34-4e.3 provides for "conditional uses" under the same <br />type of district; and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at the City Hall on <br />October 31, 1994, at 7:30 p.m. recommended an amendment of Section 34-40.3 of the <br />University City Zoning Code by adding "outdoor bus parking facility" to Section <br />34-4~.3; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in <br />the City Council Chambers at City Hall at 7:30 p.m., November 7, 1994, was duly <br />published in the Watchman-Advocate, a newspaper of general circulation within <br />said City on October 20, 1994; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in <br />said notice, and all suggestions or objections concerning said amendment were <br />duly heard and considered by the council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CiTY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS= <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University <br />City, Missouri, relating to zoning is hereby amended by repealing Section 34-40.3 <br />thereof, relating to "Conditional Uses", and enacting in lieu thereof a new <br />section to be known as "Section 34-40.3, Conditional Uses", relating to the same <br />subject, and re-enacting said section so that said section, as so amended, shall <br />read as follows: <br /> <br />Business, professional, medical or institutional offices. <br /> <br />Hospitals, residential and outpatient substance abuse treatment <br />centers, and other institutions of a religious, educational <br />charitable or philanthropic nature, provided that such buildings <br />shall not be Located upon sites containing less than three (8) <br /> <br />Public utilities and services, including sub-stations, special <br />rights of way and easements, provided that the exterior appearance <br />of any building so permitted shall be in keeping with the character <br />of the neighborhood in which it is located. <br /> <br />d.
