BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER SCHUMAN <br /> <br />8204 ORDINANCE NO. 5989 <br /> <br />AN ORDINANCE GRANTING, SELLING AND CONVEYING TO TIVOLI BUILDING, <br />L.L.C., A PERMANENT EASEMENT IN A STRIP OF GROUND ALONG THE <br />SOUTHWESTERN EDGE OF 6344 DELMAR BOULEVARD. <br /> <br /> WHEREAS, TiVOIi Building, L,L.C. desires to construct an addition to the <br />women's restroom in the southeastern part of its building at 6346-7e Delmar <br />Boulevard; and <br /> <br /> WHEREAS, said addition will obstruct emergency egress from the building; <br />and <br /> <br /> WHEREAS, to ensure emergency egress from the building, Tivoli Building, <br />L.L.C. has requested an easement in a strip of ground owned by the City of <br />University City; and <br /> <br /> WHEREAS, the easement will further the preservation of the health, safety, <br />morals and general welfare of the people of the City of University City; and <br /> <br /> WHEREAS, the City of University City is willing to grant, sell and convey <br />to Tivoli Building, L.L.C. the requested easement. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY AS FOLLOWS: <br /> <br /> Section 1. The City of University City is the owner of land described as <br />follows: <br /> <br />A lot in Block 2 of Parkview and in U.S. Survey 378, Township 45 <br />North, Range 6 East as recorded in Plat Book 6 Page 22 of the St. <br />Louis County Records and more particularly described as follows: <br /> <br />Fronting 5~ feet on the south line of Delmar Boulevard, by a depth <br />southwardly of 11~ feet more or less to an alley. Bounded east by <br />a line 300 feet west of the west line of Limit Avenue, together with <br />all improvements thereon; and a parcel of land in Block 2 of <br />Parkview, according to plat thereof recorded in Plat Book 6 Page 22 <br />of the St. Louis County, records, fronting 108 feet on the south <br />line of Delmar Boulevard by a depth southwardly of 110 feet, more or <br />less, to an alley bounded on the east by a line distant 208 feet <br />west of the west line of Linlit Avenue. <br /> <br /> Section 2. In consideration of the sum of ten dollars ($18), and other <br />good and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, the City of University City, grantor hereby grants, sells and <br />conveys to Tivoli Building, L.L.C., of 65~4 Delmar Boulevard, City of University <br />City, County of St. Louis, Missouri, grantee, the following~ <br /> <br />The use of a strip of ground four feet in width along the <br />southernmost western edge of grantor's said property, being the <br />common boundary between grantor's said property and grantee's <br />property adjoining to the west, said strip of ground to be used for <br />an exit discharge from the fire escape located on the east side of <br />grantee's existing building. <br /> <br /> <br />
