Section 3. The easement granted hereby shall be subject to grantoP's <br />right, upon construction of any improvements on gPantor's said land, to require <br />grantee promptly to release said easement upon the recording of an easement fPoffi <br />grantor conveying to grantee a permanent easement on grantor's said lot along or <br />through any such improvements, which newly granted easement shall at a minimum <br />provide grantee with sufficient "exit discharge" from grantee's said fire escape <br />which will provide all occupants of grantee's said building with "safe access to <br />a public way" (or the equivalent under then existing applicable building codes), <br />to allow grantee to at all times be in full compliance with all applicable <br />building codes governing emergency exits, and specifically governing said fire <br />escape, then in effect. <br /> <br /> Section 4. The easement granted by this ordinance is for the benefit of <br />and appurtenant to that real property, or any portion of such property, in the <br />County of St. Louis County, State of Missouri, described as follows: <br /> <br />A lot in Block 2 of Parkview and in U.S, Survey 378, Township 45 <br />North, Range 6 East as recorded in Plat Book 6 Page 22 of the St. <br />Louis County records and is more particularly described as follows= <br /> <br />Beginning at a chiseled Cross on the south line of Delmar Boulevard <br />(8~ feet wide), distant north 89 degrees west, along an assumed <br />bearing, 350 feet from the west line of Limit Avenue (5~ feet wide), <br />said cross also being the northeast corner of said lot; thence south <br />01 degree 14 minutes 30 seconds west, 110 feet to a chiseled cross <br />at the southeast corner of thereof, said cross also being on the <br />south line of an alley (15 feet wide); thence along the south line <br />of said alley north 89 degrees west, 193 feet to an iron pipe at the <br />south west corner thereof; thence north ~1 degree 14 minutes 30 <br />seconds east, 110 feet to a P.K. Nail at the northwest corner <br />thereof, said nail also being on the south line of said Delmar <br />Boulevard; thence south 89 degrees east along the south line of <br />Delmar Boulevard, 193 feet to the point of beginning. <br /> <br /> Section 5, This ordinance shall take effect and be in force from and after <br />its passage as provided by law, <br /> <br />PASSED this 21st day of <br /> <br />November , 1994. <br /> <br />ATTEST: <br /> <br /> CiTY CLERK <br /> <br />CERTIFIED TO BE CORRECT AS TO FORM= <br /> <br /> <br />
