BILL NO. <br /> <br />INTRODUCED BY COUNCII~IE~ER SCHOOHER <br /> ORDINANCE NO, 6022 <br /> <br />AN ORDINANCE AMENDING CHAPTER 1 OF THE MUNICIPAL CODE OF <br />UNIVERSITY CITY, RELATING TO GENERAL PROVISIONS, BY REPEALING <br />SECTION 1-8.2 THEREOF, AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS 'SECTION 1-8.2. ASSESSMENT OF SPECIAL <br />COURT COSTS;' CONTAINING A SAVING CLAUSE. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, <br />AS FOLLOWS: <br /> <br /> Section 1. Chapter 1 of the Municipal Code of the City of University City, <br />relating to general provisions, is hereby amended by repealing Section 1-8.2 <br />thereof, relating to assessment of court costs, and enacting in lieu thereof, a new <br />section to be knawn as "Section 1-8.2, Assessment of Special Court Costs," relating <br />to the same subject, so that said section, as so amended, shall read as follows: <br /> <br />SFCTION 1--8.?. ASSESSMFNT OF SPECIAL COURT COSTS <br /> <br />(a) In addition to all other court costs: <br /> <br />(1) <br /> <br />A fee of five dollars ($5.00) shall be assessed as court <br />costs against a defendant in each court proceeding for <br />violation of a municipal ordinance except that no such <br />fee shall be collected for any non-moving traffic <br />violations, except violations of weight limit and safety <br />laws, and no such fee shall be collected when the <br />proceeding or the defendant has been dismissed by the <br />court or when costs are to be paid by the City on behalf <br />of an indigent defendant. The clerk of the municipal <br />court shall collect such court costs. <br /> <br />(2) <br /> <br />At least monthly, ninety-five percent (95%) of the court <br />costs collected by the municipal court clerk pursuant to <br />paragraph (a)(1) shall be paid to the Missouri Director of <br />Revenue for the crime victims' compensation fund and <br />the services to victims fund, and the remaining five <br />percent (5%) shall be paid into the City treasury. <br /> <br />(b) In addition to all other court costs: <br /> <br />(1) <br /> <br />A judge of the municipal court may assess a fee of up to <br />two dollars ($2.00) as court costs against a defendant in <br />each court proceeding for violation of a municipal <br />ordinance, provided that no such fee shall be collected <br />for non-moving traffic violations, and no such fee shall be <br />collected when the proceeding or the defendant has <br />been dismissed by the court. The clerk of the municipal <br />court shall collect such court costs. <br /> <br /> <br />
