BILL NO. <br /> <br />8242 <br /> <br />INTRODUCED BY COUNCILM~{BER SCHOOMER <br /> <br /> ORDINANCE NO. <br /> <br />6026 <br /> <br />AN ORDINANCE AMENDING CHAPTER 25 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY, RELATING TO RETIREMENT AND PENSIONS, <br />BY REPEALING SECTION 25-24 AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 25-24. SAME-PHYSICAL <br />EXAMINATIONS REQUIRED; ADJUSTMENT OR TERMINATION OF BENEFITS; <br />REPORTS TO THE BOARD;" CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, <br />AS FOLLOWS: <br /> <br /> Section 1. Chapter 25 of the Municipal Code of the City of University City, <br />relating to retirement and pensions, is hereby amended by repealing Section 25-24 <br />and enacting in lieu thereof a new section to be known as "Section 25-24. Same- <br />Physical Examinations Required; Adjustment or Termination of Benefits; Reports to <br />the Board;" so that said section, as so amended, shall read as follows: <br /> <br />Section 25-24. <br /> <br />Same-Physical Examinations Required; Adjustment <br />or Termination of Benefits: Reports to the Board. <br /> <br />The Board of Trustees shall have the right to require every employee <br />receiving disability benefits under this article, prior to attaining age <br />fifty-five (55), to undergo a physical examination by the physician or <br />medical board designated by the Board of Trustees at such <br />reasonable times as the Board shall deem necessary. Should any such <br />examination disclose that the employee is able to resume their <br />employment as a police officer or firefighter, the right of such <br />employee to further benefits hereunder shall terminate, and any such <br />employee refusing to submit to any such examination shall receive no <br />further disability benefits pending such employee's submission thereto. <br />If such refusal continues for a period of one (1) year, all rights of such <br />employee to retirement or disability benefits under this article shall <br />terminate. In the event any employee receiving disability benefits <br />should subsequently be found to have recovered from such disability, <br />then the Board of Trustees shall notify the personnel director of the City <br />in writing of the fact and that such employee is eligible to be restored <br />to their former active service. Upon such finding, the personnel <br />director shall restore such employee to their former position with their <br />previous date of rank and longevity therein continuous and inclusive <br />of the period during which such employee was disabled. <br /> <br /> <br />
