If an employee engages in any form of employment or performs any <br />compensable work, whether as an employee or as an independent <br />contractor, or receives outside income from a trade or business while <br />he or she is receiving disability benefits under this adicle, then the <br />benefits payable to such person under this article shall be adjusted so <br />that when the sum of their benefits under this article and their earnings <br />from such work and/or trade or business during any three (3) month <br />period exceeds; (a) in the case of an employee whose benefits under <br />this article commence on or before June 30, 1995, twice the amount <br />of current base pay during such period, or (b) in the case of an <br />employee whose benefits under this article commence on or after <br />July 1, 1995, the amount of current base pay during such period, their <br />benefit under this article shall be reduced by $.50 for each $1.00 of <br />excess. CUrrent base pay shall be determined with reference to the <br />position held by the person at the time he or she was determined to <br />be disabled. Employees receiving disability benefits shall be required <br />to report to the Board at intervals, when requested by the Board, and <br />give full details with reference to their employment. Any such <br />employee failing to make satisfactory reports or found to have <br />knowingly made a false report shall forfeit all future benefits <br />hereunder. <br /> <br /> Section ?. An emergency is hereby declared to exist in that this ordinance <br />needs to be effective as of July 1, 1995, the beginning of the new fiscal year.
