and is directly interfering with the normal movement of <br />traffic, or the maintenance and care, or the emergency <br />use of the highway, street, alley, or municipal lot; or <br /> <br />b. Constitutes a hazard to traffic or the safety of others; or <br /> <br />c. Blocks the use of a fire hydrant; or <br /> <br />d. Is in an emergency lane. <br /> <br />The Police Department is authorized to remove or cause to be <br />removed to a place of safety any vehicle when the operator of <br />the vehicle is taken into custody and the vehicle would thereby <br />be left unaHended: <br /> <br />Upon the property of another without the consent of the <br />owner or person in possession of the property; or <br /> <br />b. Upon a highway, street, alley, or municipal lot. <br /> <br />The Police Department is authorized to remove or cause to be <br />removed to a place of safety any vehicle that is stolen or taken <br />without the consent of the owner. <br /> <br />The Public Works Department is authorized to remove or cause <br />to be removed to a place of safety any vehicle that is on <br />private property and constitutes a hazard to the safety of <br />others. <br /> <br />o <br /> <br />Any vehicle subject to removal under this section is a public <br />nuisance. <br /> <br />The operator and owner of any vehicle subject to removal <br />under paragraphs 1 or 4 of this section shall be in violation of this <br />section and subject to prosecution therefor. <br /> <br />o <br /> <br />The operator and owner of any vehicle removed under this <br />section shall be responsible for payment of all removal and <br />storage costs unless the City Manager or his/her designee <br />determines pursuant to Section 21-169 of this chapter that <br />removal was not authorized. <br /> <br />The authority granted in this section is in addition to any other <br />authority the Police and Public Works Departments may have <br /> <br /> <br />
